  1.1                          A bill for an act
  1.2             relating to human services; requiring the commissioner 
  1.3             of human services to implement a medication therapy 
  1.4             management pilot program; appropriating money. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [MEDICATION THERAPY MANAGEMENT PILOT PROGRAM.] 
  1.7      Subdivision 1.  [ESTABLISHMENT.] The commissioner of human 
  1.8   services, in consultation with the advisory committee 
  1.9   established under subdivision 2, shall implement, beginning July 
  1.10  1, 2001, a two-year medication therapy management pilot program 
  1.11  for medical assistance enrollees.  Medication therapy management 
  1.12  must be provided by teams of physicians and pharmacists working 
  1.13  in collaborative practice, as defined in Minnesota Statutes, 
  1.14  section 151.01, subdivision 27, clause (5), to help patients use 
  1.15  medications safely and effectively.  The commissioner may enroll 
  1.16  individual pharmacists who participate in the pilot program as 
  1.17  medical assistance providers and shall seek to ensure that 
  1.18  participating pharmacists represent all geographic regions of 
  1.19  the state. 
  1.20     Subd. 2.  [ADVISORY COMMITTEE.] The commissioner shall 
  1.21  establish a ten-member medication therapy management advisory 
  1.22  committee, to advise the commissioner in the implementation and 
  1.23  administration of the program and the development of eligibility 
  1.24  criteria for enrollees and providers and requirements for 
  1.25  collaborative practice agreements.  The committee shall be 
  2.1   comprised of:  two licensed physicians; two licensed 
  2.2   pharmacists; two consumer representatives; three members with 
  2.3   expertise in the area of medication therapy management, who may 
  2.4   be licensed physicians or licensed pharmacists; and a 
  2.5   representative of the commissioner, who shall serve as an 
  2.6   ex-officio nonvoting member.  In appointing members who are not 
  2.7   consumer representatives, the commissioner shall consider 
  2.8   recommendations of associations representing pharmacy and 
  2.9   medical practitioners.  The committee is governed by section 
  2.10  15.059, except that committee members do not receive 
  2.11  compensation or reimbursement for expenses. 
  2.12     Subd. 3.  [EVALUATION.] The commissioner shall evaluate the 
  2.13  cost-effectiveness of the pilot program and its effect on 
  2.14  patient outcomes and quality of care, and shall report to the 
  2.15  legislature by December 15, 2003.  The commissioner may contract 
  2.16  with a vendor to conduct the evaluation. 
  2.17     Sec. 2.  [APPROPRIATION.] 
  2.18     $....... is appropriated from the general fund to the 
  2.19  commissioner of human services for the biennium ending June 30, 
  2.20  2003, to implement section 1.
