  1.1                          A bill for an act 
  1.2             relating to human services; creating a pilot project 
  1.3             in Goodhue county to downsize an existing ICF/MR 
  1.4             facility. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [DOWNSIZING PILOT PROJECT IN GOODHUE COUNTY.] 
  1.7      (a) The commissioner of human services shall establish a 
  1.8   pilot project in Goodhue county to downsize to 21 beds an 
  1.9   existing 60-bed intermediate care facility for persons with 
  1.10  mental retardation or related conditions.  The project must be 
  1.11  approved by the commissioner under Minnesota Statutes, section 
  1.12  252.28, and must include criteria for determining how 
  1.13  individuals are selected for alternative services.  The project 
  1.14  must include:  
  1.15     (1) alternative services for the residents being relocated; 
  1.16     (2) timelines for resident relocation and decertification 
  1.17  of beds; and 
  1.18     (3) adjustment of the facility's operating cost rate under 
  1.19  Minnesota Rules, part 9553.0050, as necessary to implement the 
  1.20  project. 
  1.21     (b) The facility's aggregate investment-per-bed limit in 
  1.22  effect before downsizing must be the facility's 
  1.23  investment-per-bed limit after downsizing.  The facility's total 
  1.24  revenues after downsizing must not increase as a result of the 
  1.25  downsizing project.  The facility's total revenues before 
  2.1   downsizing are determined by multiplying the payment rate in 
  2.2   effect the day before the downsizing is effective by the number 
  2.3   of resident days for the reporting year preceding the downsizing 
  2.4   project.  For the purpose of this project, the average medical 
  2.5   assistance rate for home and community-based services must not 
  2.6   exceed the rate made available under Laws 1992, chapter 513, 
  2.7   article 5, section 2.
