  1.1                          A bill for an act 
  1.2             relating to education; providing for athletic 
  1.3             participation for pupils who enroll in a nonresident 
  1.4             district; amending Minnesota Statutes 1994, section 
  1.5             120.062, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 120.062, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 13.  [ATHLETIC PARTICIPATION.] If a pupil enrolls in 
  1.10  a nonresident district under this section, the pupil is 
  1.11  ineligible to participate in the extracurricular varsity or 
  1.12  junior varsity athletic activities of the nonresident district 
  1.13  for one school year.  During that year of ineligibility in the 
  1.14  nonresident district, the pupil remains eligible to participate 
  1.15  in the extracurricular varsity or junior varsity athletic 
  1.16  activities of the pupil's resident district, or in the 
  1.17  extracurricular varsity athletic activities of the nonpublic 
  1.18  school the pupil attended prior to enrolling in a public school 
  1.19  under this section.  After the year of ineligibility expires, 
  1.20  the pupil is eligible to participate in the extracurricular 
  1.21  varsity or junior varsity athletic activities in the nonresident 
  1.22  district or in the resident district or nonpublic school the 
  1.23  pupil attended prior to enrolling in public school under this 
  1.24  section.  The pupil may not participate in extracurricular 
  1.25  varsity or junior varsity activities in both the resident 
  2.1   district and the nonresident district.  The same restrictions 
  2.2   apply to a pupil who transfers from one participating 
  2.3   nonresident district to another participating nonresident 
  2.4   district. 
  2.5      A pupil may participate in the extracurricular varsity or 
  2.6   junior varsity athletic activities of the nonresident district 
  2.7   during the year of ineligibility if any of the following 
  2.8   conditions are met: 
  2.9      (1) the pupil demonstrates that the distance the pupil 
  2.10  would be required to travel between the resident and nonresident 
  2.11  district would prevent the pupil from participating in the 
  2.12  extracurricular varsity or junior varsity athletic activities of 
  2.13  the resident district; 
  2.14     (2) the extracurricular varsity or junior varsity athletic 
  2.15  activity is not offered by the pupil's resident district or by 
  2.16  the nonresident district from which the pupil is transferring; 
  2.17     (3) the pupil was denied equal opportunity to participate 
  2.18  in extracurricular varsity or junior varsity athletic activities 
  2.19  in the pupil's resident district or nonresident district from 
  2.20  which the pupil is transferring because of inequity in access as 
  2.21  described under section 126.21; or 
  2.22     (4) the superintendents in the resident and nonresident 
  2.23  districts agree in writing to allow a nonresident pupil to 
  2.24  participate in the extracurricular varsity or junior varsity 
  2.25  athletic activities of the nonresident district during the year 
  2.26  of ineligibility. 
  2.27     Sec. 2.  [EFFECTIVE DATE.] 
  2.28     Section 1 is effective the day following final enactment 
  2.29  and applies to pupils attending a nonresident district under 
  2.30  Minnesota Statutes, section 120.062, in the 1995-1996 and later 
  2.31  academic years.  Notwithstanding Minnesota Statutes, section 
  2.32  120.062, subdivision 6, a pupil who has notified a nonresident 
  2.33  district of the pupil's intent to enroll under this section for 
  2.34  the 1995-1996 school year as of the effective date of section 1 
  2.35  and who does not want to attend the nonresident district because 
  2.36  of the requirements in section 1, may attend school in the 
  3.1   resident district for the 1995-1996 academic year if the pupil 
  3.2   notifies the school boards of the nonresident and resident 
  3.3   districts in writing by August 1, 1995, of the pupil's intent to 
  3.4   attend the resident district for the 1995-1996 school year.
