1.1 A bill for an act 1.2 relating to transportation; imposing surcharge on 1.3 fines for littering by throwing cigarettes from a 1.4 motor vehicle; amending Minnesota Statutes 2002, 1.5 section 169.42, subdivisions 1, 5. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2002, section 169.42, 1.8 subdivision 1, is amended to read: 1.9 Subdivision 1. [DANGEROUS OBJECT ON HIGHWAY.] No person 1.10 shall throw, deposit, place or dump, or cause to be thrown, 1.11 deposited, placed or dumped upon any street or highway or upon 1.12 any public or privately owned land adjacent thereto without the 1.13 owner's consent any snow, ice, cigarettes, glass bottle, glass, 1.14 nails, tacks, wire, cans, garbage, swill, papers, ashes, refuse, 1.15 carcass of any dead animal, offal, trash or rubbish or any other 1.16 form of offensive matter or any other substance likely to injure 1.17 any person, animal or vehicle upon any such street or highway. 1.18 Sec. 2. Minnesota Statutes 2002, section 169.42, 1.19 subdivision 5, is amended to read: 1.20 Subd. 5. [MISDEMEANOR.] Any person violating the 1.21 provisions of this section is guilty of a misdemeanor. The 1.22 record of any conviction of or plea of guilty under this section 1.23 of a person operating a motor vehicle shall be immediately 1.24 forwarded to the department of public safety for inclusion upon 1.25 that offender's driving record. A person who violates this 2.1 section by throwing a cigarette from a motor vehicle is assessed 2.2 an additional surcharge equal to the amount of the fine imposed 2.3 for the violation. Any second or subsequent offense under this 2.4 section shall require a minimum fine in the amount of $400. Any 2.5 judge may, for any violation of this section, order the offender 2.6 to pick up litter along any public highway or road for four to 2.7 eight hours under the direction of the department of 2.8 transportation, with the option of a jail sentence being imposed.
