  1.1                          A bill for an act 
  1.2             relating to education; providing that interest on 
  1.3             obligations issued or agreements entered into to 
  1.4             finance health and safety program projects are valid 
  1.5             health and safety programs expenditures; amending 
  1.6             Minnesota Statutes 2000, section 123B.57, subdivision 
  1.7             6. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2000, section 123B.57, 
  1.10  subdivision 6, is amended to read: 
  1.11     Subd. 6.  [USES OF HEALTH AND SAFETY REVENUE.] Health and 
  1.12  safety revenue may be used only for approved expenditures 
  1.13  necessary to correct fire safety hazards, life safety hazards, 
  1.14  or for the removal or encapsulation of asbestos from school 
  1.15  buildings or property, asbestos-related repairs, cleanup and 
  1.16  disposal of polychlorinated biphenyls found in school buildings 
  1.17  or property, or the cleanup, removal, disposal, and repairs 
  1.18  related to storing heating fuel or transportation fuels such as 
  1.19  alcohol, gasoline, fuel oil, and special fuel, as defined in 
  1.20  section 296A.01, labor and industry regulated facility and 
  1.21  equipment hazards, and health, safety, and environmental 
  1.22  management.  Health and safety revenue may also be used to pay 
  1.23  interest costs on obligations issued or installment contracts, 
  1.24  lease-purchase agreements, or other authorized deferred payments 
  1.25  agreements entered into to finance the cost of health and safety 
  1.26  program projects.  Health and safety revenue must not be used 
  2.1   for the construction of new facilities or the purchase of 
  2.2   portable classrooms.  The revenue may not be used for a building 
  2.3   or property or part of a building or property used for 
  2.4   post-secondary instruction or administration or for a purpose 
  2.5   unrelated to elementary and secondary education. 
  2.6      [EFFECTIVE DATE.] This section is effective July 1, 2001, 
  2.7   and applies to interest costs on obligations issued or 
  2.8   agreements entered into prior to that date.
