A bill for an act
relating to data practices; permitting sharing of law enforcement data in certain
circumstances; amending Minnesota Statutes 2010, sections 13.82, by adding a
subdivision; 13.84, by adding subdivisions.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2010, section 13.82, is amended by adding a subdivision
to read:

Any law enforcement agency
may share not public data with any probationary agency for use in preparing release
recommendations, sentencing recommendations, or supervision of individuals. Not public
data shared with a probationary agency remain classified pursuant to this section.

Minnesota Statutes 2010, section 13.84, is amended by adding a subdivision to
read:

A court services department,
parole or probation authority, correctional agency, or other agent authorized by the court
may prepare a domestic violence history summary that compiles information regarding an
individual's domestic violence-related acts. The summary is confidential data but may be
shared for criminal justice related purposes with the court, a law enforcement agency, a
prosecuting authority, a court services department, parole or probation authority, state or
local correctional agency, or an agency or authorized agent performing pretrial release
supervision or studies. Nothing in this section shall be interpreted to prevent the release
of the information in the domestic violence history summary to the defendant's counsel
when the domestic violence history summary is submitted to the court for consideration at
a hearing.

read:

pursuant to section 13.82, subdivision 30, remain classified pursuant to that section and
may be released as provided in subdivision 5.
