1.1A resolution
1.2memorializing the Congress of the United States not to reauthorize the No Child
1.3Left Behind Act.
1.4WHEREAS, although the intent is worthy, the No Child Left Behind Act represents a
1.5wrongful and unacceptable federal intrusion into state and local control of education, which
1.6violates time-honored American principles of balanced federalism and respect for state and
1.7local prerogatives; and
1.8WHEREAS, the No Child Left Behind Act coerces participation by placing punitive
1.9financial consequences on states who might choose not to participate; and
1.10WHEREAS, the No Child Left Behind Act is an unfunded mandate causing states and
1.11school districts to spend more money to implement the No Child Left Behind Act than what
1.12Congress appropriates; and
1.13WHEREAS, the No Child Left Behind Act is contrary to the Tenth Amendment of the
1.14United States Constitution, which restricts the powers of the federal government to those so
1.15delegated by the United States Constitution and reserves powers not delegated to the federal
1.16government, such as education, to the states and to the people; NOW, THEREFORE,
1.17BE IT RESOLVED by the Legislature of the State of Minnesota that it urges the Congress
1.18of the United States to repeal the No Child Left Behind Act.
1.19BE IT FURTHER RESOLVED by the Legislature of the State of Minnesota that it urges
1.20the Congress of the United States to only provide education funding to the states in the form of
1.21education block grants and for meeting shortfalls under the federal Individuals with Disabilities
1.22Education Act.
2.1BE IT FURTHER RESOLVED that the Secretary of State of the State of Minnesota is
2.2directed to prepare copies of this memorial and transmit them to the President and the Secretary of
2.3the United States Senate, the Speaker and the Clerk of the United States House of Representatives,
2.4the chair of the Senate Committee on Health, Education, Labor, and Pensions, the chair of the
2.5House Committee on Education and the Workforce, and Minnesota's Senators and Representatives
2.6in Congress so that may be apprised of the sense of the Minnesota Legislature in this matter.
