  1.1                          A bill for an act 
  1.2             relating to education funding; replacing the two-year 
  1.3             lag of the base year for special education and limited 
  1.4             English proficiency programs with a one-year lag; 
  1.5             amending Minnesota Statutes 1998, sections 124D.65, 
  1.6             subdivision 1; and 125A.76, subdivision 1. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 124D.65, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [ADJUSTED LEP BASE REVENUE.] (a) A 
  1.11  district's adjusted limited English proficiency programs base 
  1.12  revenue for fiscal year 1996 and later equals the product of: 
  1.13     (1) the district's base revenue for limited English 
  1.14  proficiency programs under this section and section 125A.77, 
  1.15  times 
  1.16     (2) the ratio of: 
  1.17     (i) the greater of 20 or the number of pupils of limited 
  1.18  English proficiency enrolled in the district during the current 
  1.19  fiscal year to 
  1.20     (ii) the greater of 20 or the number of pupils of limited 
  1.21  English proficiency enrolled in the district during the base 
  1.22  year. 
  1.23     (b) For the purposes of this section, the base year for 
  1.24  fiscal year 1996 is fiscal year 1995.  The base year for fiscal 
  1.25  year 2000 and later fiscal years is the second fiscal year 
  1.26  preceding the fiscal year for which aid shall be paid.  The 
  2.1   current year is the fiscal year for which aid shall be paid. 
  2.2      (c) For the purposes of this section, a teacher includes 
  2.3   nonlicensed personnel who provide direct instruction to students 
  2.4   of limited English proficiency under the supervision of a 
  2.5   licensed teacher. 
  2.6      Sec. 2.  Minnesota Statutes 1998, section 125A.76, 
  2.7   subdivision 1, is amended to read: 
  2.8      Subdivision 1.  [DEFINITIONS.] For the purposes of this 
  2.9   section and section 125A.77, the definitions in this subdivision 
  2.10  apply. 
  2.11     (a) "Base year" for fiscal year 1998 2000 and later fiscal 
  2.12  years means the second fiscal year preceding the fiscal year for 
  2.13  which aid will be paid. 
  2.14     (b) "Basic revenue" has the meaning given it in section 
  2.15  126C.10, subdivision 2.  For the purposes of computing basic 
  2.16  revenue pursuant to this section, each child with a disability 
  2.17  shall be counted as prescribed in section 126C.05, subdivision 1.
  2.18     (c) "Essential personnel" means teachers, related services, 
  2.19  and support services staff providing direct services to students.
  2.20     (d) "Average daily membership" has the meaning given it in 
  2.21  section 126C.05. 
  2.22     (e) "Program growth factor" means 1.00 for fiscal year 2000 
  2.23  and later. 
  2.24     (f) "Aid percentage factor" means 60 percent for fiscal 
  2.25  year 1996, 70 percent for fiscal year 1997, 80 percent for 
  2.26  fiscal year 1998, 90 percent for fiscal year 1999, and 100 
  2.27  percent for fiscal years 2000 and later. 
  2.28     (g) "Levy percentage factor" means 100 minus the aid 
  2.29  percentage factor for that year. 
  2.30     Sec. 3.  [EFFECTIVE DATE.] 
  2.31     Sections 1 and 2 are effective for revenue for fiscal years 
  2.32  2000 and later.
