  1.1                          A bill for an act 
  1.2             relating to education; codifying law giving parents 
  1.3             access to statewide tests; directing the commissioner 
  1.4             of children, families, and learning to annually 
  1.5             release increasingly greater portions of statewide 
  1.6             test questions; amending Laws 2001, First Special 
  1.7             Session chapter 6, article 2, section 68.  
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Laws 2001, First Special Session chapter 6, 
  1.10  article 2, section 68, is amended to read: 
  1.11     Sec. 68.  [ACCESS TO TESTS.] 
  1.12     The commissioner of children, families, and learning must 
  1.13  adopt and publish a policy to provide public and parental access 
  1.14  for review of basic skills tests, Minnesota comprehensive 
  1.15  assessments, or any other such statewide test and 
  1.16  assessment annually administered in any grade 3 through 12.  
  1.17  Upon receiving a written request, the commissioner must make 
  1.18  available to parents or guardians a copy of their student's 
  1.19  actual answer sheet to the test questions.  The commissioner 
  1.20  annually must release test questions and answer keys and make 
  1.21  available to parents and the public increasingly greater 
  1.22  cumulative portions of test and assessment questions and answers 
  1.23  under this section, so that by the end of the 2006-2007 school 
  1.24  year, all test assessment questions and answers are released.  
  1.25     The aligned state assessments shall consist of machine 
  1.26  scoreable questions with one correct answer each, except English 
  2.1   essay tests, which must measure objective knowledge and be 
  2.2   graded on grammar, mechanics, and usage.  
  2.3      [EFFECTIVE DATE.] This section is effective February 1, 
  2.4   2002 September 1, 2003. 
  2.5      Sec. 2.  [REVISOR INSTRUCTION.] 
  2.6      The revisor of statutes shall codify Laws 2001, First 
  2.7   Special Session chapter 6, article 2, section 68, as amended by 
  2.8   this act, as Minnesota Statutes, section 120B.305.
