1.1 A bill for an act 1.2 relating to education; modifying the use of class-size 1.3 reduction revenue; amending Minnesota Statutes 1994, 1.4 section 124A.225, subdivisions 4 and 5. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 1994, section 124A.225, 1.7 subdivision 4, is amended to read: 1.8 Subd. 4. [REVENUE USE.] (a) Revenue must be used according 1.9 to either paragraph (b),or (c), or (d). 1.10 (b) Revenue shall be used to reduceand maintainthe 1.11 district's instructor to learner ratios in kindergarten through 1.12 grade 6to a level of 1 to 17 on averageand maintain them at 1.13 reduced levels.The district must prioritize the use of the1.14revenue to attain this level initially in kindergarten and grade1.151 and then through the subsequent grades as revenue is available.1.16 (c)Notwithstanding paragraph (b), for fiscal year 1995, a1.17district with exceptional need as defined in subdivision 6,1.18paragraph (a), may use the revenue to reduce and maintain the1.19district's instructor-to-learner ratios in kindergarten through1.20grade 6 to a level that is at least 2.0 less than the district's1.21adopted staffing ratio, if the remaining learning and1.22development revenue is used to continue or initiate staffing1.23patterns that meet the needs of a diverse student population.1.24Programs to meet the needs of a diverse student population may1.25include programs for at-risk pupils and learning enrichment2.1programs.2.2(d) For fiscal year 1995 only, in any school building that2.3meets the characteristics of exceptional need as defined in2.4subdivision 6, paragraph (b), a district may use the revenue to2.5employ education assistants or aides supervised by a learner's2.6regular instructor to assist learners in those school buildings.2.7(e)The revenue may be used to prepare and use an 2.8 individualized learning plan for each learner. A district must 2.9 not increase the district wide instructor-learner ratios in 2.10 other grades as a result of reducing instructor-learner ratios 2.11 in kindergarten through grade 6. Revenue may not be used to 2.12 provide instructor preparation timeor to provide the district's2.13share of revenue required under section 124.311. A school2.14district may use a portion of the revenue reserved under this2.15section to employ up to the same number of full-time equivalent2.16education assistants or aides as the district employed during2.17the 1992-1993 school year under Minnesota Statutes 1992, section2.18124.331, subdivision 2. 2.19 Sec. 2. Minnesota Statutes 1994, section 124A.225, 2.20 subdivision 5, is amended to read: 2.21 Subd. 5. [ADDITIONAL REVENUE USE.] If the school board of 2.22 a school district determines that the district has achieved and 2.23 is maintaining the instructor-learner ratios specifiedin2.24subdivision 4by the school board and is using individualized 2.25 learning plans, the school board may use the revenue to purchase 2.26 material and services or provide staff development needed for 2.27 reduced instructor-learner ratios. If additional revenue 2.28 remains, the district must use the revenue to improve program 2.29 offerings, including programs provided through interactive 2.30 television, throughout the district or other general education 2.31 purposes. 2.32 Sec. 3. [EFFECTIVE DATE.] 2.33 Sections 1 and 2 are effective July 1, 1995.
