  1.1                          A bill for an act
  1.2             relating to education; creating funding for school 
  1.3             districts that offer year-round education; authorizing 
  1.4             bonds; proposing coding for new law in Minnesota 
  1.5             Statutes, chapters 120 and 124. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [120.635] [FLEXIBLE LEARNING YEAR PROGRAM 
  1.8   FUNDING.] 
  1.9      A school district that operates a flexible learning year 
  1.10  program is eligible for funding according to sections 2 and 3. 
  1.11     Sec. 2.  [124.70] [FLEXIBLE LEARNING YEAR PROGRAM REVENUE.] 
  1.12     Subdivision 1.  [PLANNING GRANTS.] A school district that 
  1.13  intends to operate a flexible learning year program under 
  1.14  sections 120.59 to 120.66 is eligible for a one-time planning 
  1.15  and implementation grant.  In order to qualify for a planning 
  1.16  grant, the district must submit an application to the 
  1.17  commissioner of education.  The planning and implementation 
  1.18  grant amount equals the lesser of $25 per actual pupil unit or 
  1.19  $100,000 for each qualifying school district.  Implementation 
  1.20  revenue may be used for: 
  1.21     (1) collaborative planning with city and county officials; 
  1.22  and 
  1.23     (2) planning within the district, including curriculum 
  1.24  revisions, scheduling changes, staff development, and public 
  1.25  awareness. 
  2.1      Subd. 2.  [OPERATIONAL REVENUE.] A school district that 
  2.2   operates a flexible learning year program is eligible for 
  2.3   additional general fund operating revenue.  The commissioner of 
  2.4   education shall annually determine the number of pupils 
  2.5   attending school in the district beyond the district's 
  2.6   traditional year capacity.  For each year, an eligible 
  2.7   district's additional operating revenue equals the product of: 
  2.8      (1) $1,500; 
  2.9      (2) the district's excess capacity pupils; and 
  2.10     (3) the district's excess pupil percentage. 
  2.11     A district's excess pupil percentage is determined 
  2.12  according to the following schedule:

  2.24     Subd. 3.  [FACILITIES REVENUE.] Each year, a district 
  2.25  operating a flexible learning year program is eligible for 
  2.26  additional capital facilities revenue of $25 per pupil unit. 
  2.27     Subd. 4.  [COLLABORATIVE REVENUE.] School districts 
  2.28  operating a flexible learning year program are encouraged to 
  2.29  collaborate with cities, counties, and other providers of 
  2.30  services for school-age children.  If a district's flexible 
  2.31  learning year plan includes collaborative efforts, the district 
  2.32  is eligible for collaborative revenue equal to $100 per pupil 
  2.33  unit.  Collaborative revenue must be spent on recreational 
  2.34  programs, day camp programs, day care programs, and other 
  2.35  programs offered jointly with cities and counties to provide 
  2.36  activities for students who are not otherwise in school because 
  2.37  of the flexible learning year schedule. 
  2.38     Sec. 3.  [124.705] [FLEXIBLE LEARNING YEAR BUILDING 
  2.39  GRANTS.] 
  2.40     Subdivision 1.  [GRANTS.] A district that operates a 
  2.41  flexible learning year program is eligible for a building grant 
  3.1   of up to $100,000 per building. 
  3.2      Subd. 2.  [USES OF GRANT.] The grant must be used to make 
  3.3   heating, ventilation, and air conditioning changes to existing 
  3.4   buildings in order to make the buildings accessible for the full 
  3.5   year.  The grants may also be used for deferred maintenance 
  3.6   approved by the commissioner of education. 
  3.7      Subd. 3.  [ISSUANCE AND SALE OF BONDS.] To provide money 
  3.8   for flexible learning year building grants, the commissioner of 
  3.9   finance, upon the request of the commissioner of education, 
  3.10  shall issue and sell bonds of the state up to the amount of 
  3.11  $6,000,000 in the manner, upon the terms, and with the effect 
  3.12  prescribed by sections 16A.631 to 16A.675 and the Minnesota 
  3.13  Constitution, article XI, sections 4 to 7.
