  1.1                          A bill for an act 
  1.2             relating to health; establishing health risk values 
  1.3             for pollutants in ambient air; proposing coding for 
  1.4             new law in Minnesota Statutes, chapter 144. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [144.405] [HEALTH RISK VALUES.] 
  1.7      Subdivision 1.  [PROCEDURE.] (a) If air quality data show 
  1.8   there is degradation of ambient air or a potential for adverse 
  1.9   health effects, the commissioner of health may promulgate health 
  1.10  risk values under subdivision 2 for substances polluting ambient 
  1.11  air. 
  1.12     (b) Health risk values shall be determined by one of the 
  1.13  methods in paragraph (c) or (d) depending on the substance's 
  1.14  toxicological end point. 
  1.15     (c) For systemic toxicants that are not carcinogens, the 
  1.16  adopted health risk values shall be derived using United States 
  1.17  Environmental Protection Agency risk assessment methods; and 
  1.18  using toxicological data determined by the commissioner to have 
  1.19  undergone thorough scientific review. 
  1.20     (d) For toxicants that are known or probable carcinogens, 
  1.21  the adopted health risk values shall be derived from a 
  1.22  quantitative estimate of the chemical's carcinogenic potency and 
  1.23  determined by the commissioner to have undergone thorough 
  1.24  scientific review. 
  1.25     Subd. 2.  [RULES.] (a) Health risk values shall be adopted 
  2.1   by rule under chapter 14. 
  2.2      (b) If the commissioner determines that emergency 
  2.3   conditions exist, the commissioner shall promulgate the adopted 
  2.4   health risk limits notwithstanding chapter 14 through 
  2.5   publication in the State Register but the health risk values 
  2.6   adopted under this paragraph are effective for only one year.  
  2.7      Subd. 3.  [REVIEW AND REVISION.] (a) The commissioner shall 
  2.8   review each adopted health risk value at least every four years. 
  2.9      (b) The commissioner may revise health risk values under 
  2.10  subdivision 2.
