  1.1                          A bill for an act 
  1.2             relating to lotteries; requiring the director to 
  1.3             establish sports pool games; establishing a 
  1.4             professional and amateur sports account in the general 
  1.5             fund, to which all net proceeds from these games must 
  1.6             be credited; amending Minnesota Statutes 1996, 
  1.7             sections 349A.04; 349A.10, subdivision 5; and 349A.13; 
  1.8             proposing coding for new law in Minnesota Statutes, 
  1.9             chapter 349A. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 1996, section 349A.04, is 
  1.12  amended to read: 
  1.13     349A.04 [LOTTERY GAME PROCEDURES.] 
  1.14     Subdivision 1.  [GENERALLY.] The director may adopt game 
  1.15  procedures governing the following elements of the lottery: 
  1.16     (1) lottery games; 
  1.17     (2) ticket prices; 
  1.18     (3) number and size of prizes; 
  1.19     (4) methods of selecting winning tickets; and 
  1.20     (5) frequency and method of drawings. 
  1.21     Subd. 2.  [SPORTS POOL GAMES.] The director shall adopt 
  1.22  game procedures for a game or games based upon the results of 
  1.23  sporting events. 
  1.24     Subd. 3.  [ADMINISTRATIVE PROCEDURES EXEMPTION.] The 
  1.25  adoption of lottery game procedures is not subject to chapter 14.
  1.26     Sec. 2.  Minnesota Statutes 1996, section 349A.10, 
  1.27  subdivision 5, is amended to read: 
  2.1      Subd. 5.  [DEPOSIT OF NET PROCEEDS.] Within 30 days after 
  2.2   the end of each month, the director shall deposit in the state 
  2.3   treasury the net proceeds of the lottery, which is the balance 
  2.4   in the lottery fund after transfers to the lottery prize fund 
  2.5   and credits to the lottery operations account.  Of the net 
  2.6   proceeds other than net proceeds from sports pool games under 
  2.7   section 349A.04, subdivision 2, 40 percent must be credited to 
  2.8   the Minnesota environment and natural resources trust fund, and 
  2.9   the remainder must be credited to the special revenue fund 
  2.10  created in section 16A.67, subdivision 3.  Money credited to the 
  2.11  special revenue fund must be transferred to the debt service 
  2.12  fund established in section 16A.67, subdivision 4, at the times 
  2.13  and in the amounts determined by the commissioner of finance to 
  2.14  be necessary to provide for the payment and security of bonds 
  2.15  issued pursuant to section 16A.67.  On or before the tenth day 
  2.16  of each month, any money in the special revenue fund not 
  2.17  required to be transferred to the debt service fund must be 
  2.18  transferred to the general fund.  The net proceeds from all 
  2.19  sports pool games under section 349A.04, subdivision 2, must be 
  2.20  credited to the professional and amateur sports account created 
  2.21  in section 349A.16. 
  2.22     Sec. 3.  Minnesota Statutes 1996, section 349A.13, is 
  2.23  amended to read: 
  2.24     349A.13 [RESTRICTIONS.] 
  2.25     Nothing in this chapter: 
  2.26     (1) authorizes the director to conduct a lottery game or 
  2.27  contest the winner or winners of which are determined by the 
  2.28  result of a sporting event other than a horse race conducted 
  2.29  under chapter 240; 
  2.30     (2) authorizes the director to install or operate a lottery 
  2.31  device operated by coin or currency which when operated 
  2.32  determines the winner of a game; and 
  2.33     (3) (2) authorizes the director to sell pull-tabs as 
  2.34  defined under section 349.12, subdivision 32. 
  2.35     Sec. 4.  [349A.16] [PROFESSIONAL AND AMATEUR SPORTS 
  2.36  ACCOUNT.] 
  3.1      An account to be known as the professional and amateur 
  3.2   sports account is created in the general fund.  The account 
  3.3   consists of the net proceeds from sports pool games credited to 
  3.4   it under section 349A.10, subdivision 5.  The legislature shall 
  3.5   make appropriations from the account to aid the development and 
  3.6   retention of professional and amateur sports in the state, 
  3.7   including appropriations for the acquisition or betterment of 
  3.8   facilities for major league baseball. 
  3.9      Sec. 5.  [EFFECTIVE DATE.] 
  3.10     Sections 1 to 4 are effective the day following final 
  3.11  enactment.
