  1.2             relating to natural resources; renaming a state park; 
  1.3             adding to and deleting from state parks; authorizing a

  1.6             wayside; authorizing a private sale of surplus land in 
  1.7             Rock county; renaming the visitor's center at 
  1.8             Gooseberry Falls state park; amending Minnesota 
  1.9             Statutes 1998, section 85.012, subdivision 19; 
  1.10            proposing coding for new law in Minnesota Statutes, 
  1.11            chapter 85; repealing Minnesota Statutes 1998, section 
  1.12            85.013, subdivision 8.  
  1.13  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.14     Section 1.  Minnesota Statutes 1998, section 85.012, 
  1.15  subdivision 19, is amended to read: 
  1.16     Subd. 19.  Forestville Mystery Cave state park, Fillmore 
  1.17  county. 
  1.18     Sec. 2.  [ADDITIONS TO STATE PARKS.] 
  1.19     Subdivision 1.  [85.012] [Subd. 2.] [BANNING STATE PARK, 
  1.20  PINE COUNTY.] The following area is added to Banning state park, 
  1.21  all in Section 15, Township 42 North, Range 20 West, Pine 
  1.22  county:  That part of the Northeast Quarter of the Northwest 
  1.23  Quarter of Section 15 lying easterly of the following described 
  1.24  line:  Commencing at the northeast corner of the intersection of 
  1.25  Division Street and Palisade Avenue in the recorded plat of 
  1.26  Sandstone, Pine county, Minnesota; thence southerly along the 
  1.27  east line of said Palisade Avenue 868 feet, more or less, to the 
  1.28  south line of said Northeast Quarter of the Northwest Quarter; 
  1.29  thence easterly along said south line 360 feet to the point of 
  2.1   beginning; thence northwesterly to a point 160 feet easterly 
  2.2   along the easterly extension of the north line of said Division 
  2.3   Street from the point of commencement; thence northerly parallel 
  2.4   with the northerly extension of the east line of said Palisade 
  2.5   Avenue to the north line of said Northeast Quarter of the 
  2.6   Northwest Quarter and there terminating. 
  2.7      Subd. 2.  [85.012] [Subd. 10.] [CAMDEN STATE PARK, LYON 
  2.8   COUNTY.] The following areas are added to Camden state park, all 
  2.9   in Township 110 North, Range 42 West, Lyon county: 
  2.10     (1) the East Half of Section 6; 
  2.11     (2) the Northeast Quarter of Section 7; 
  2.12     (3) that part of the Southwest Quarter of the Southwest 
  2.13  Quarter except the South 345 feet of the East 1065 feet of 
  2.14  Section 8 lying outside of the existing statutory boundary; 
  2.15     (4) that part of the Northwest Quarter of the Northwest 
  2.16  Quarter of Section 17 described as follows:  Beginning at the 
  2.17  northwest corner of the North Half of the Northwest Quarter of 
  2.18  Section 17; thence South on and along the west section line 
  2.19  870.66 feet; thence East and perpendicular with the west section 
  2.20  line a distance of 40 feet; thence North and parallel with the 
  2.21  west section line a distance of 420.66 feet; thence in a 
  2.22  northeasterly direction to a point on the north section line of

  2.30  park, all in Section 34, Township 61 North, Range 1 West, Cook 
  2.31  county:  That part of Government Lot 2, Section 34, which lies 
  2.32  northwesterly of a line run parallel with and distant 100 feet 
  2.33  northwesterly of the following described line:  Beginning at a 
  2.34  point on the westerly line of Section 25, Township 61 North, 
  2.35  Range 1 West, distant 2373.0 feet south of the northwest corner 
  2.36  thereof; thence run in a southwesterly direction at an angle of 
  3.1   66 degrees 46 minutes 00 seconds from said westerly line 
  3.2   (measured from south to west) for a distance of 1323.1 feet; 
  3.3   thence deflect to the right on a 01 degree 00 minute 00 second 
  3.4   curve (delta angle 10 degrees 21 minutes 00 seconds) for a

  3.21  Searles Addition to the city of Little Falls; 
  3.22     (2) all that part of Government Lot 5, Section 19, Township 
  3.23  129 North, Range 29 West, described as follows:  Commencing at 
  3.24  the southwest corner of said Section 19; thence North 4 degrees 
  3.25  55 minutes East along the west side of Searles City Acre Lots 
  3.26  649.7 feet to the northwest corner of Lot 8 of said Searles City 
  3.27  Acre Lots, which point shall henceforth be known as the point of

  4.34  county: 
  4.35     (1) the Northeast Quarter of the Southeast Quarter of the 
  4.36  Southeast Quarter, except the North Half of the East 16 acres of 
  5.1   the Southeast Quarter of the Southeast Quarter of said Section 
  5.2   19; 
  5.3      (2) the Northwest Quarter of the Southeast Quarter of the 
  5.4   Southeast Quarter; 
  5.5      (3) the Southwest Quarter of the Southeast Quarter of the 
  5.6   Southeast Quarter, except the East 1 acre; and

  5.20  KITTSON COUNTY.] The following areas are added to Lake Bronson 
  5.21  state park, all in Township 161 North, Range 46 West, Kittson 
  5.22  county: 
  5.23     (1) all of Section 28; 
  5.24     (2) the Northeast Quarter of the Southwest Quarter of 
  5.25  Section 27; 
  5.26     (3) the East Half of the Northwest Quarter of Section 27 
  5.27  except the area described as follows:  Beginning at a point on 
  5.28  the north line of the said East Half of the Northwest Quarter 
  5.29  that is 2640.00 feet East of the northwest corner of said 
  5.30  Section 27; thence South and parallel to the west line of said 
  5.31  Section 27 a distance of 200 feet; thence West and parallel to 
  5.32  the north section line 300 feet; thence North and parallel to

  6.1   PARK, CHISAGO COUNTY.] The following area is added to St. Croix 
  6.2   Wild River state park:  That part of Government Lot 7, Section 
  6.3   31, Township 36 North, Range 19 West, Chisago county, lying 
  6.4   outside the existing statutory boundary, excepting therefrom the 
  6.5   East 460 feet. 
  6.6      Subd. 9.  [85.012] [Subd. 52.] [SCENIC STATE PARK, ITASCA 
  6.7   COUNTY.] The following area is added to Scenic state park:  
  6.8   Government Lot 7, Section 7, Township 60 North, Range 25 West, 
  6.9   Itasca county, except that part described as follows:  
  6.10  Commencing at a point on the water's edge of Lake Elizabeth 
  6.11  (also known as Marie Lake) 165 feet East of the west line of 
  6.12  said Lot 7; thence North 165 feet; thence West 165 feet to the 
  6.13  west line of Lot 7; thence North 200 feet on the west line to a 
  6.14  point which is the point of beginning of the tract to be 
  6.15  excepted; thence East 300 feet; thence South to the water's edge 
  6.16  of Lake Elizabeth; thence West along the shoreline to the west 
  6.17  boundary of Lot 7; thence North along the west boundary to the 
  6.18  point of beginning.  
  6.19     Subd. 10.  [85.012] [Subd. 55.] [TEMPERANCE RIVER STATE 
  6.20  PARK, COOK COUNTY.] (a) The following areas are added to 
  6.21  Temperance River state park, all in Township 59 North, Range 4 
  6.22  West, Cook county: 
  6.23     (1) all of Section 19 except the East Half of the Northeast 
  6.24  Quarter; 
  6.25     (2) the North Half of the Northwest Quarter, the Southeast 
  6.26  Quarter, and the Southeast Quarter of the Southwest Quarter of 
  6.27  Section 20; 
  6.28     (3) the Northwest Quarter, the Southwest Quarter of the 
  6.29  Northeast Quarter, the North Half of the Southwest Quarter, and 
  6.30  that part of the Northwest Quarter of the Southeast Quarter 
  6.31  lying north of trunk highway No. 61 of Section 29; 
  6.32     (4) all of Section 30; and 
  6.33     (5) the Northwest Quarter, the Northwest Quarter of the

  6.36     (b) The commissioner of natural resources shall administer 
  7.1   the area described in paragraph (a) according to Minnesota 
  7.2   Statutes, section 86A.05, subdivision 2, but in addition to 
  7.3   other activities authorized in Temperance River state park, 
  7.4   shall allow public hunting. 
  7.5      Subd. 11.  [85.012] [Subd. 59.] [WHITEWATER STATE PARK, 
  7.6   WINONA COUNTY.] The following areas are added to Whitewater 
  7.7   state park, all in Township 107 North, Range 10 West, Winona 
  7.8   county:  
  7.9      (1) all that part of the Southwest Quarter of the Southwest 
  7.10  Quarter of Section 21, lying northerly and westerly of the 
  7.11  following described lines:  Commencing at the southwest corner 
  7.12  of said Section 21; thence North 00 degrees 15 minutes West 
  7.13  655.00 feet on and along the west line thereof to the point of 
  7.14  beginning; thence North 89 degrees 45 minutes East 150.00 feet;

  9.2   lying East of Oxboro Avenue, Section 26, Township 32 North, 
  9.3   Range 20 West; 
  9.4      (2) the East Half of the Northeast Quarter; the Northeast 
  9.5   Quarter of the Southeast Quarter, and all that part of the 
  9.6   Southeast Quarter of the Southeast Quarter lying North of the 
  9.7   so-called Chisago City and Marine Mills Road (now Old Marine 
  9.8   Trail), Section 35, Township 32 North, Range 20 West; 
  9.9      (3) all that part of the Southwest Quarter of the Southwest 
  9.10  Quarter of Section 36, Township 32 North, Range 20 West, which 
  9.11  lies north of the centerline of the Chisago City and Marine

 10.1   Beginning at a point on the east and west quarter line of 
 10.2   Section 30, Township 32 North, Range 19 West, distant 2681 feet 
 10.3   east of the west quarter corner thereof; thence run 
 10.4   northwesterly at an angle of 85 degrees 27 minutes 00 seconds 
 10.5   from said east and west quarter line (measured from west to 
 10.6   north) for a distance for 466.1 feet; thence deflect to the left 
 10.7   on a 04 degree 00 minutes 00 seconds curve, delta angle 48

 10.10     Sec. 3.  [EXCHANGE OF LAND IN LAKE BRONSON STATE PARK.] 
 10.11     [85.012] [Subd. 34.] [LAKE BRONSON STATE PARK, KITTSON 
 10.12  COUNTY.] Notwithstanding Minnesota Statutes, section 94.342, 
 10.13  subdivision 4, the commissioner of natural resources may 
 10.14  exchange, subject to the approval of the land exchange board as 
 10.15  required by the Minnesota Constitution, article XI, section 10, 
 10.16  the state-owned Lot 11 of Block 7 for the privately-owned Lot 5 
 10.17  of Block 5 in Lakeside Subdivision according to the plat 
 10.18  thereof, all in Section 33, Township 161 North, Range 46 West. 
 10.19     Sec. 4.  [TRANSFER OF LAND FROM CROSS RIVER STATE WAYSIDE 
 10.20  TO TEMPERANCE RIVER STATE PARK AND WAYSIDE ABOLISHMENT.] 
 10.21     Subdivision 1.  [85.012] [Subd. 55.] [TEMPERANCE RIVER 
 10.22  STATE PARK, COOK COUNTY.] (a) The lands described within Cross 
 10.23  River state wayside are transferred to Temperance River state 
 10.24  park. 
 10.25     (b) The commissioner of natural resources shall administer 
 10.26  the area transferred under paragraph (a) according to Minnesota 
 10.27  Statutes, section 86A.05, subdivision 2, but in addition to 
 10.28  other activities authorized in Temperance River state park, 
 10.29  shall allow public hunting. 
 10.30     Subd. 2.  [85.013] [Subd. 8.] [CROSS RIVER STATE WAYSIDE, 
 10.31  COOK COUNTY.] The Cross River state wayside is abolished and its 
 10.32  lands transferred according to subdivision 1. 
 10.33     Sec. 5.  [DELETION FROM BLUE MOUNDS STATE PARK.] 
 10.34     [85.012] [Subd. 8.] [BLUE MOUNDS STATE PARK, ROCK 
 10.35  COUNTY.] The following area is deleted from Blue Mounds state 
 10.36  park:  That part of the Southwest Quarter of the Southwest 
 11.1   Quarter of Section 25, Township 103 North, Range 45 West, lying 
 11.2   south and east of county state-aid highway No. 8, Rock county. 
 11.3      Sec. 6.  [PRIVATE SALE OF SURPLUS LAND, ROCK COUNTY.] 
 11.4      (a) Notwithstanding Minnesota Statutes, sections 94.09 and 
 11.5   94.10, the commissioner of natural resources may sell by private 
 11.6   sale to the adjacent landowner the surplus land described in 
 11.7   paragraph (c).  If the adjacent landowner declines to purchase 
 11.8   the land, the commissioner may sell the land by public sale 
 11.9   according to Minnesota Statutes, sections 94.10 to 94.16. 
 11.10     (b) The conveyance must be in a form approved by the 
 11.11  attorney general for consideration no less than the appraised 
 11.12  value of the land. 
 11.13     (c) The land to be conveyed is located in Rock county, 
 11.14  consists of four acres, more or less, and is described as:  That 
 11.15  part of the Southwest Quarter of the Southwest Quarter of 
 11.16  Section 25, Township 103 North, Range 45 West, lying 
 11.17  southeasterly of county state-aid highway (CSAH) No. 8 and 
 11.18  southwesterly of the following described line: 
 11.19     Commencing at a point 707.7 feet east of the southwest 
 11.20  corner of said Section 25; thence East 646.3 feet; thence North 
 11.21  1296.0 feet; thence West 833.0 feet; thence turning an angle of 
 11.22  135 degrees 11 minutes to the left for a distance of 600.0 feet 
 11.23  to the intersection of the center line of the public highway, 
 11.24  hereinafter called CSAH No. 8; thence turning an angle of 87 
 11.25  degrees 49 minutes to the right along the center line of CSAH 
 11.26  No. 8 for a distance of 615.0 feet to the point of beginning of 
 11.27  the line to be described; thence turning an angle of 75 degrees 
 11.28  00 minutes to the left for a distance of 505.7 feet to the point 
 11.29  of commencement and there terminating. 
 11.30     (d) The land described in paragraph (c) is deleted from the 
 11.31  Blue Mounds state park under section 5.  The commissioner has 
 11.32  determined that the land is no longer needed for any natural 
 11.33  resource purpose and that the state's land management interests 
 11.34  would best be served if the land was returned to private 
 11.35  ownership. 
 11.36     Sec. 7.  [JOE ALEXANDER VISITOR'S CENTER AT GOOSEBERRY 
 12.1   FALLS STATE PARK.] 
 12.2      The visitor's center at Gooseberry Falls state park is 
 12.3   renamed the Joe Alexander Visitor's Center. 
 12.4      Sec. 8.  [REPEALER.] 
 12.5      Minnesota Statutes 1998, section 85.013, subdivision 8, is 
 12.6   repealed.
