  1.1                          A bill for an act
  1.2             relating to juvenile court; providing for a petition 
  1.3             for child in need of protection or services for 
  1.4             certain children in certain licensed facilities; 
  1.5             proposing coding for new law in Minnesota Statutes, 
  1.6             chapter 257. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [257.045] [DELAY IN REMOVAL OF CHILDREN FROM 
  1.9   CERTAIN FACILITIES; PETITION.] 
  1.10     If a parent or legal guardian seeks to remove a homeless 
  1.11  child from a facility licensed under Minnesota Rules, parts 
  1.12  9545.0945 to 9545.1125, the facility may prevent the child's 
  1.13  removal for three business days for purposes of filing a 
  1.14  petition under section 260.131 alleging that the child is in 
  1.15  need of protection or services.  For purposes of this section, 
  1.16  "homeless" means: 
  1.17     (1) the child has been abandoned by a parent or legal 
  1.18  guardian; 
  1.19     (2) the child has been a victim of physical or sexual abuse 
  1.20  or emotional maltreatment; 
  1.21     (3) the environment of the child's parent or legal guardian 
  1.22  is injurious or dangerous to the child or others including, but 
  1.23  not limited to, exposing the child to or involving the child in 
  1.24  criminal activity; or 
  1.25     (4) the parent or guardian is homeless.
