  1.1                          A bill for an act 
  1.2             relating to crime prevention; limiting who can benefit 
  1.3             from profits derived from prostitution; amending 
  1.4             Minnesota Statutes 1994, section 609.323, subdivisions 
  1.5             2, 3, and by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 609.323, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  Whoever, not related by blood, adoption, or 
  1.10  marriage to the prostitute, while acting other than as a 
  1.11  prostitute or patron, intentionally receives profit, knowing or 
  1.12  having reason to know that it is derived from the prostitution, 
  1.13  or the promotion of the prostitution, of an individual in 
  1.14  circumstances described in section 609.322, subdivision 2, 
  1.15  clause (3), may be sentenced to not more than three years 
  1.16  imprisonment or to payment of a fine of not more than $5,000, or 
  1.17  both.  
  1.18     Sec. 2.  Minnesota Statutes 1994, section 609.323, 
  1.19  subdivision 3, is amended to read: 
  1.20     Subd. 3.  Whoever, not related by blood, adoption, or 
  1.21  marriage to the prostitute, while acting other than as a 
  1.22  prostitute or patron, intentionally receives profit, knowing or 
  1.23  having reason to know that it is derived from the prostitution, 
  1.24  or the promotion of the prostitution of an individual 18 years 
  1.25  of age or above may be sentenced to imprisonment for not more 
  2.1   than one year or to payment of a fine of not more than $3,000, 
  2.2   or both.  
  2.3      Sec. 3.  Minnesota Statutes 1994, section 609.323, is 
  2.4   amended by adding a subdivision to read: 
  2.5      Subd. 3a.  [EXCEPTIONS.] Subdivisions 1a, 2, and 3 do not 
  2.6   apply to a minor who is dependent on an individual acting as a 
  2.7   prostitute and who may have benefited from or been supported by 
  2.8   the individual's earnings derived from prostitution. 
  2.9      Sec. 4.  [EFFECTIVE DATE.] 
  2.10     Sections 1 to 3 are effective August 1, 1995, and apply to 
  2.11  crimes committed on or after that date.
