  1.1                          A bill for an act 
  1.2             relating to agriculture; providing service contractor 
  1.3             investment protection; proposing coding for new law in 
  1.4             Minnesota Statutes, chapter 17. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [17.925] [INVESTMENT PROTECTION FOR SERVICE 
  1.7   CONTRACTORS.] 
  1.8      Subdivision 1.  [QUALIFYING INVESTMENTS BY SERVICE 
  1.9   CONTRACTOR.] The notice required in subdivision 2 must be given 
  1.10  to a provider of contracted agricultural services, including but 
  1.11  not limited to commercial solid or liquid manure management or 
  1.12  application services, who is required to make a capital 
  1.13  investment of $100,000 or more in equipment having a useful life 
  1.14  of at least five years in order to meet the minimum service 
  1.15  needs of a contract with a single agricultural producer.  
  1.16     Subd. 2.  [INVESTMENT PROTECTION.] An agricultural producer 
  1.17  that has contracted with a service provider covered by 
  1.18  subdivision 1 may not terminate or cancel the contract without 
  1.19  providing 180 days written notice before the effective date of 
  1.20  the termination or cancellation except as provided in 
  1.21  subdivision 3. 
  1.22     Subd. 3.  [IMMEDIATE TERMINATION FOR CAUSE.] The notice 
  1.23  required in subdivision 2 is not required and the contract may 
  1.24  be terminated or canceled immediately if the alleged grounds for 
  1.25  termination or cancellation are: 
  2.1      (1) voluntary abandonment of the contract relationship by 
  2.2   the contracted agricultural services provider; or 
  2.3      (2) conviction of the contracted agricultural services 
  2.4   provider of an offense directly related to the business provided 
  2.5   under the contract.
