A bill for an act
relating to commerce; coordinating Minnesota and
federal law in regard to consumer access to their own
credit information; amending Minnesota Statutes 2004,
section 13C.01, subdivision 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 13C.01,
subdivision 1, is amended to read:


Subdivision 1.

Fee for report.

(a) new text begin Credit reporting
agencies shall provide Minnesota consumers with one free
consumer report every 12 months upon request as required under
United States Code, title 15, section 1681j(a), and the
regulations adopted under that provision.

new text begin (b) In addition to the free report required under paragraph
(a),
new text end a consumer who is the subject of a consumer report
maintained by a consumer reporting agency is entitled to request
and receive by mail new text begin or e-mailnew text end , for a charge not to exceed $3, a
copy of the consumer report once in any 12-month period. The
mailing new text begin or e-mailing new text end must contain a statement of the consumer's
right to dispute and correct any errors and of the procedures
set forth in the federal Fair Credit Reporting Act, United
States Code, title 15, sections 1681 et seq., for that purpose.
The consumer reporting agency shall respond to a request under
this deleted text begin subdivision deleted text end new text begin paragraph new text end within 30 days.

consumer report in order to confirm that the consumer report was

provide a link to a Web site at which the consumer may access
