A bill for an act
relating to transportation; highways; requiring periodic review of property owned
or controlled by the department for the purpose of determining surplus; requiring
a report; amending Minnesota Statutes 2012, section 161.41, subdivision 1, by
adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2012, section 161.41, subdivision 1, is amended to read:
The commissioner is
authorized to declare as surplus any property acquired by the state for highway purposesdeleted text begin ,
excluding real estate, whichdeleted text end new text begin thatnew text end the commissioner determines deleted text begin to bedeleted text end new text begin isnew text end no longer needed
or necessary for state highway purposes.
Minnesota Statutes 2012, section 161.41, is amended by adding a subdivision
to read:

(a) The commissioner shall examine all tracts or lots of
real property belonging to the state and under the control or supervision of the department
to determine whether any lands or tracts may be declared as surplus. For those lands or
tracts deemed surplus, the commissioner shall determine whether the property is suitable
for sale or some other means of disposal.

(b) The commissioner is authorized to sell or dispose of surplus tracts or lots of real
property identified under paragraph (a) following the procedures set forth in sections
161.41 to 161.442.

(c) The commissioner shall report on its findings under paragraph (a) to the house
of representatives and senate committees with jurisdiction over transportation policy
and finance by March 1 of each even-numbered year. The report may be submitted
electronically, and is subject to section 3.195, subdivision 1.

(d) For purposes of this subdivision, "surplus" means tracts or lots of real property
no longer needed or necessary for state highway purposes, or which have not been used
for state highway purposes for a period of five years.
