A bill for an act
relating to transportation; providing for periodic review of real property owned
by the state for purposes of declaring a surplus; requiring a report; amending
Minnesota Statutes 2012, section 161.44, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2012, section 161.44, is amended by adding a
subdivision to read:

new text begin (a) The commissioner shall examine all real property
owned by the state and under the custodial control of the department, to decide whether
any may be declared as surplus and suitable for sale or some other means of disposal.

new text begin (b) The commissioner shall report on its findings under paragraph (a) to the
legislative committees with jurisdiction over transportation policy and finance by March 1
of each odd-numbered year. The report may be submitted electronically, and is subject
to section 3.195, subdivision 1.

new text begin (c) For purposes of this subdivision, "surplus" means real property no longer needed
or necessary for trunk highway purposes, and that has not been used for trunk highway
purposes for a period of five years or more.
