  1.1                          A bill for an act 
  1.2             relating to legislature; changing the membership of 
  1.3             the legislative commissions on pensions and retirement 
  1.4             and Minnesota resources; amending Minnesota Statutes 
  1.5             1996, sections 3.85, subdivision 3; and 116P.05, 
  1.6             subdivision 1. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 3.85, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [MEMBERSHIP.] The commission consists of five ten 
  1.11  members of the senate appointed by the subcommittee on 
  1.12  committees of the committee on rules and administration and five 
  1.13  ten members of the house of representatives appointed by the 
  1.14  speaker.  Members shall be appointed at the commencement of each 
  1.15  regular session of the legislature for a two-year term beginning 
  1.16  January 16 of the first year of the regular session.  Vacancies 
  1.17  that occur while the legislature is in session shall be filled 
  1.18  like regular appointments.  If the legislature is not in 
  1.19  session, senate vacancies shall be filled by the last 
  1.20  subcommittee on committees of the senate committee on rules and 
  1.21  administration or other appointing authority designated by the 
  1.22  senate rules, and house vacancies shall be filled by the last 
  1.23  speaker of the house, or if the speaker is not available, by the 
  1.24  last chair of the house rules committee. 
  1.25     Sec. 2.  Minnesota Statutes 1996, section 116P.05, 
  1.26  subdivision 1, is amended to read: 
  2.1      Subdivision 1.  [MEMBERSHIP.] (a) A legislative commission 
  2.2   on Minnesota resources of 16 20 members is created, consisting 
  2.3   of the chairs of the house and senate committees on environment 
  2.4   and natural resources or designees appointed for the terms of 
  2.5   the chairs, the chairs of the house ways and means and senate 
  2.6   finance committees or designees appointed for the terms of the 
  2.7   chairs, six eight members of the senate appointed by the 
  2.8   subcommittee on committees of the committee on rules and 
  2.9   administration, and six eight members of the house appointed by 
  2.10  the speaker.  
  2.11     At least two three members from the senate and two three 
  2.12  members from the house must be from the minority caucus.  
  2.13  Members are entitled to reimbursement for per diem expenses plus 
  2.14  travel expenses incurred in the services of the commission.  
  2.15     (b) Members shall appoint a chair who shall preside and 
  2.16  convene meetings as often as necessary to conduct duties 
  2.17  prescribed by this chapter. 
  2.18     (c) Members shall serve on the commission until their 
  2.19  successors are appointed. 
  2.20     (d) Vacancies occurring on the commission shall not affect 
  2.21  the authority of the remaining members of the commission to 
  2.22  carry out their duties, and vacancies shall be filled in the 
  2.23  same manner under paragraph (a).
