  1.2             relating to education; increasing funding for limited 
  1.3             English proficiency programs; removing the statewide 
  1.4             revenue cap; lowering the student instructor ratio; 
  1.5             appropriating money; amending Minnesota Statutes 1996, 
  1.6             section 124.273, subdivisions 1d and 1g; repealing 
  1.7             Minnesota Statutes 1996, section 124.273, subdivision 
  1.8             1f. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1996, section 124.273, 
  1.11  subdivision 1d, is amended to read: 
  1.12     Subd. 1d.  [LEP BASE REVENUE.] (a) The For fiscal years 
  1.13  1998 and later, limited English proficiency programs base 
  1.14  revenue equals the sum of the following amounts, computed 
  1.15  using base current year data:  
  1.16     (1) 68 percent of the salary of one full-time equivalent 
  1.17  teacher for each 40 25 pupils of limited English proficiency 
  1.18  enrolled, or 68 percent of the salary of one-half of a full-time 
  1.19  teacher in a district with 20 10 or fewer pupils of limited 
  1.20  English proficiency enrolled; and 
  1.21     (2) for supplies and equipment purchased or rented for use 
  1.22  in the instruction of pupils of limited English proficiency an 
  1.23  amount equal to 47 percent of the sum actually spent by the 
  1.24  district but not to exceed an average of $47 in any one school 
  1.25  year for each pupil of limited English proficiency receiving 
  1.26  instruction. 
  1.27     (b) For the purposes of this subdivision, a teacher 
  2.1   includes nonlicensed personnel who provide direct instruction to 
  2.2   students of limited English proficiency under the supervision of 
  2.3   a licensed teacher. 
  2.4      Sec. 2.  Minnesota Statutes 1996, section 124.273, 
  2.5   subdivision 1g, is amended to read: 
  2.6      Subd. 1g.  [SCHOOL DISTRICT LEP REVENUE.] (a) A school 
  2.7   district's limited English proficiency programs revenue for 
  2.8   fiscal year 1996 1998 and later equals the state total limited 
  2.9   English proficiency programs revenue, minus the amount 
  2.10  determined under paragraph (b), times the ratio of the 
  2.11  district's adjusted limited English proficiency programs base 
  2.12  revenue to the state total adjusted limited English proficiency 
  2.13  programs base revenue. 
  2.14     (b) Notwithstanding paragraph (a), if the limited English 
  2.15  proficiency programs base revenue for a district equals zero, 
  2.16  the limited English proficiency programs revenue equals the sum 
  2.17  of the following amounts, computed using current year data: 
  2.18     (1) 68 percent of the salary of one full-time equivalent 
  2.19  teacher for each 40 pupils of limited English proficiency 
  2.20  enrolled, or 68 percent of the salary of one-half of a full-time 
  2.21  teacher in a district with 20 or fewer pupils of limited English 
  2.22  proficiency enrolled; and 
  2.23     (2) for supplies and equipment purchased or rented for use 
  2.24  in the instruction of pupils of limited English proficiency an 
  2.25  amount equal to 47 percent of the sum actually spent by the 
  2.26  district but not to exceed an average of $47 in any one school 
  2.27  year for each pupil of limited English proficiency receiving 
  2.28  instruction amount calculated under subdivision 1d. 
  2.29     Sec. 3.  [APPROPRIATIONS.] 
  2.30     Subdivision 1.  [DEPARTMENT OF CHILDREN, FAMILIES, AND 
  2.31  LEARNING.] The sums indicated in this section are appropriated 
  2.32  from the general fund to the department of children, families, 
  2.33  and learning for the fiscal years indicated. 
  2.34     Subd. 2.  [LEP PROGRAMS.] For limited English proficiency 
  2.35  programs under Minnesota Statutes, section 124.273: 
  2.36     $ 12,830,000     .....     1998
  3.1      $ 16,300,000     .....     1999
  3.2      The 1998 appropriation includes $930,000 for fiscal year 
  3.3   1997 and $11,900,000 for fiscal year 1999.  The 1999 
  3.4   appropriation includes $1,332,000 for fiscal year 1998 and 
  3.5   $14,968,000 for fiscal year 1999.  
  3.6      Sec. 3.  [REPEALER.] 
  3.7      Minnesota Statutes 1996, section 124.273, subdivision 1f, 
  3.8   is repealed for revenue for fiscal year 1998. 
  3.9      Sec. 4.  [EFFECTIVE DATE.] 
  3.10     Sections 1 and 2 are effective for revenue for fiscal year 
  3.11  1998.
