  1.1                          A bill for an act 
  1.2             relating to crime; making it an assault in the fourth 
  1.3             degree for certain mentally ill and dangerous or 
  1.4             sexually dangerous or sexual psychopathic persons to 
  1.5             assault department of human service employees; 
  1.6             amending Minnesota Statutes 1996, section 609.2231, by 
  1.7             adding a subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 609.2231, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 7.  [DEPARTMENT OF HUMAN SERVICE EMPLOYEES.] An 
  1.12  assault committed against an employee of the department of human 
  1.13  services is a gross misdemeanor when: 
  1.14     (1) the assault is committed while the employee is engaged 
  1.15  in the performance of a duty mandated by law, court order, or 
  1.16  ordinance; 
  1.17     (2) the assailant knows the victim is an employee of the 
  1.18  department of human services engaged in the performance of 
  1.19  official public duties; 
  1.20     (3) the assault results in demonstrable bodily harm; and 
  1.21     (4) the assailant is under commitment or being evaluated 
  1.22  for commitment as: 
  1.23     (a) a person mentally ill and dangerous to the public as 
  1.24  defined in section 253B.02, subdivision 17; 
  1.25     (b) a sexual psychopathic personality as defined in section 
  1.26  253B.02, subdivision 18a; or 
  2.1      (c) a sexually dangerous person as defined in section 
  2.2   253B.02, subdivision 18b. 
  2.3      Sec. 2.  [EFFECTIVE DATE.] 
  2.4      Section 1 is effective August 1, 1997, and applies to 
  2.5   crimes committed on or after that date.
