  1.1                          A bill for an act 
  1.2             relating to state agencies; providing that persons 
  1.3             designated as permanent commissioners serve as acting 
  1.4             commissioners until the senate has consented to their 
  1.5             appointment; limiting service as temporary or acting 
  1.6             commissioners; amending Minnesota Statutes 1998, 
  1.7             section 15.06, subdivision 5. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 15.06, 
  1.10  subdivision 5, is amended to read: 
  1.11     Subd. 5.  [EFFECT OF DESIGNATION OF ACTING OR TEMPORARY 
  1.12  COMMISSIONER.] A person who is designated acting commissioner or 
  1.13  temporary commissioner pursuant to subdivisions 3 or 4 shall 
  1.14  immediately have all the powers and emoluments and perform all 
  1.15  the duties of the office.  A person who is designated permanent 
  1.16  commissioner shall have all the powers and may perform all the 
  1.17  duties of the office as an acting commissioner upon receipt of 
  1.18  the letter of appointment by the president of the senate 
  1.19  pursuant to section 15.066.  The designee shall take office as 
  1.20  permanent commissioner upon notification of senate consent in 
  1.21  accordance with subdivision 2.  Upon the appointment of a 
  1.22  permanent commissioner or acting commissioner to succeed any 
  1.23  other acting or temporary commissioner, the subsequent appointee 
  1.24  shall immediately take the place of any other acting or 
  1.25  temporary commissioner.  No single term of service as a 
  1.26  temporary or acting commissioner may exceed 18 months.  No 
  2.1   person shall serve as a permanent commissioner or acting 
  2.2   commissioner after the senate has voted to refuse to consent to 
  2.3   the person's appointment as permanent commissioner.  Notice of 
  2.4   the designation of a commissioner or acting commissioner, or the 
  2.5   assumption of office by a temporary commissioner, shall be filed 
  2.6   with the president of the senate and the speaker of the house 
  2.7   with a copy delivered to the secretary of state and published in 
  2.8   the next available edition of the State Register. 
  2.9      Sec. 2.  [EFFECTIVE DATE.] 
  2.10     Section 1 applies to appointments made after June 30, 1999.
