  1.1                          A bill for an act 
  1.2             relating to consumer protection; prohibiting the 
  1.3             self-service merchandising of tobacco; proposing 
  1.4             coding for new law in Minnesota Statutes, chapter 325E.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [325E.077] [SELF-SERVICE MERCHANDISING OF 
  1.7   TOBACCO.] 
  1.8      Subdivision 1.  [DEFINITION.] For purposes of this section, 
  1.9   "tobacco" has the meaning given the term in section 609.685. 
  1.10     Subd. 2.  [PROHIBITION.] No person may offer tobacco for 
  1.11  sale or allow it to be sold from an open display to which the 
  1.12  public has access without the intervention of an employee. 
  1.13     Subd. 3.  [LOCAL REGULATION.] The governing body of a local 
  1.14  unit of government may adopt rules or ordinances relating to the 
  1.15  self-service merchandising of tobacco that are more restrictive 
  1.16  than the provisions of this section.
