  1.1                          A bill for an act 
  1.2             relating to natural resources; providing a standing 
  1.3             appropriation of certain funds recovered in actions 
  1.4             resulting from hazardous substance releases; amending 
  1.5             Minnesota Statutes 1994, section 115B.20, subdivision 
  1.6             1.  
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 115B.20, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [ESTABLISHMENT.] (a) The environmental 
  1.11  response, compensation, and compliance account is in the 
  1.12  environmental fund in the state treasury and may be spent only 
  1.13  for the purposes provided in subdivision 2.  
  1.14     (b) The commissioner of finance shall administer a response 
  1.15  account for the agency and the commissioner of agriculture to 
  1.16  take removal, response, and other actions authorized under 
  1.17  subdivision 2, clauses (1) to (4) and (11) to (13).  The 
  1.18  commissioner of finance shall transfer money from the response 
  1.19  account to the agency and the commissioner of agriculture to 
  1.20  take actions required under subdivision 2, clauses (1) to (4) 
  1.21  and (11) to (13).  
  1.22     (c) The commissioner of finance shall administer the 
  1.23  account in a manner that allows the commissioner of agriculture 
  1.24  and the agency to utilize the money in the account to implement 
  1.25  their removal and remedial action duties as effectively as 
  1.26  possible. 
  2.1      (d) Amounts appropriated to the commissioner of finance 
  2.2   under this subdivision shall not be included in the department 
  2.3   of finance budget but shall be included in the pollution control 
  2.4   agency and department of agriculture budgets. 
  2.5      (e) All money recovered by the state under section 115B.04 
  2.6   or any other law for injury to, destruction of, or loss of 
  2.7   natural resources resulting from the release of a hazardous 
  2.8   substance, or a pollutant or contaminant, shall be deposited in 
  2.9   the environmental response, compensation, and compliance account 
  2.10  in the environmental fund and is appropriated to the 
  2.11  commissioner of natural resources for purposes of subdivision 2, 
  2.12  clause (6), consistent with any applicable term of judgments, 
  2.13  consent decrees, consent orders, or other administration actions 
  2.14  requiring payments to the state for such purposes.
