A bill for an act
relating to human services; extending temporary personal care assistance
compensation for services provided by a parent or spouse; amending Laws 2020,
Fifth Special Session chapter 3, article 10, section 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Laws 2020, Fifth Special Session chapter 3, article 10, section 3, is amended
to read:


Sec. 3. TEMPORARY PERSONAL CARE ASSISTANCE COMPENSATION FOR
SERVICES PROVIDED BY A PARENT OR SPOUSE.

(a) Notwithstanding Minnesota Statutes, section 256B.0659, subdivisions 3, paragraph
(a), clause (1); 11, paragraph (c); and 19, paragraph (b), clause (3), during a peacetime
emergency declared by the governor under Minnesota Statutes, section 12.31, subdivision
2
, for an outbreak of COVID-19, a parent, stepparent, or legal guardian of a minor who is
a personal care assistance recipient or a spouse of a personal care assistance recipient may
provide and be paid for providing personal care assistance services.

community first services and supports program under Minnesota Statutes, section 256B.85

retroactively from February 6, 2021, or upon federal approval, whichever is later, and Laws
2020, Fifth Special Session chapter 3, article 10, section 3, is revived and reenacted as of
that date. The commissioner of human services shall notify the revisor of statutes when
federal approval is obtained.
