  1.2             relating to education finance; clarifying the current 
  1.3             funding for limited English proficiency programs; 
  1.4             amending Minnesota Statutes 2002, section 124D.65, 
  1.5             subdivision 5; 126C.10, subdivision 4; repealing 
  1.6             Minnesota Statutes 2002, section 124D.65, subdivision 
  1.7             4.  
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 124D.65, 
  1.10  subdivision 5, is amended to read: 
  1.11     Subd. 5.  [SCHOOL DISTRICT LEP REVENUE.] (a) A school 
  1.12  district's limited English proficiency programs revenue for 
  1.13  fiscal year 2000 equals the state total limited English 
  1.14  proficiency programs revenue, minus the amount determined under 
  1.15  paragraph (b), times the ratio of the district's adjusted 
  1.16  limited English proficiency programs base revenue to the state 
  1.17  total adjusted limited English proficiency programs base revenue.
  1.18     (b) Notwithstanding paragraph (a), if the limited English 
  1.19  proficiency programs base revenue for a district equals zero, 
  1.20  the limited English proficiency programs revenue equals the sum 
  1.21  of the following amounts, computed using current year data: 
  1.22     (1) 68 percent of the salary of one full-time equivalent 
  1.23  teacher for each 40 pupils of limited English proficiency 
  1.24  enrolled, or 68 percent of the salary of one-half of a full-time 
  1.25  teacher in a district with 20 or fewer pupils of limited English 
  1.26  proficiency enrolled; and 
  2.1      (2) for supplies and equipment purchased or rented for use 
  2.2   in the instruction of pupils of limited English proficiency an 
  2.3   amount equal to 47 percent of the sum actually spent by the 
  2.4   district but not to exceed an average of $47 in any one school 
  2.5   year for each pupil of limited English proficiency receiving 
  2.6   instruction. 
  2.7      (c) A district's limited English proficiency programs 
  2.8   revenue for fiscal year 2001 and later equals the product of 
  2.9   $584 times the greater of 20 or the number of adjusted marginal 
  2.10  cost pupils of limited English proficiency enrolled in the 
  2.11  district during the current fiscal year. 
  2.12     (d) (b) A pupil ceases to generate state limited English 
  2.13  proficiency aid in the school year following the school year in 
  2.14  which the pupil attains the state cutoff score on a 
  2.15  commissioner-provided assessment that measures the pupil's 
  2.16  emerging academic English. 
  2.17     Sec. 2.  Minnesota Statutes 2002, section 126C.10, 
  2.18  subdivision 4, is amended to read: 
  2.19     Subd. 4.  [BASIC SKILLS REVENUE.] (a) For fiscal year 2002, 
  2.20  a school district's basic skills revenue equals the sum of: 
  2.21     (1) compensatory revenue under subdivision 3; plus 
  2.22     (2) limited English proficiency revenue according to 
  2.23  section 124D.65, subdivision 5; plus 
  2.24     (3) $190 times the limited English proficiency pupil units 
  2.25  according to section 126C.05, subdivision 17; plus 
  2.26     (4) $22.50 times the number of adjusted marginal cost pupil 
  2.27  units in kindergarten to grade 8. 
  2.28     (b) For fiscal year 2003 and later, a school district's 
  2.29  basic skills revenue equals the sum of: 
  2.30     (1) compensatory revenue under subdivision 3; plus 
  2.31     (2) limited English proficiency revenue under section 
  2.32  124D.65, subdivision 5; plus 
  2.33     (3) $190 times the limited English proficiency pupil units 
  2.34  under section 126C.05, subdivision 17. 
  2.35     Sec. 3.  [REPEALER.] 
  2.36     Minnesota Statutes 2002, section 124D.65, subdivision 4, is 
  3.1   repealed.
