  1.1                          A bill for an act 
  1.2             relating to crime prevention; defining "day" for 
  1.3             purposes of incarceration in a jail or workhouse; 
  1.4             amending Minnesota Statutes 1998, section 609.105, by 
  1.5             adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 609.105, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 4.  [COMPUTATION OF DAYS.] (a) Except as otherwise 
  1.10  provided in paragraph (b), when a court imposes and executes a 
  1.11  sentence of imprisonment in a county jail or workhouse, or when 
  1.12  a court orders an offender to serve time in a jail or workhouse 
  1.13  as a condition of probation, the offender shall serve at least 
  1.14  24 hours in the jail or workhouse for each day of imprisonment 
  1.15  ordered by the court, minus earned good time. 
  1.16     (b) An offender described in paragraph (a) shall serve at 
  1.17  least 12 hours in the jail or workhouse during the first and 
  1.18  last days of the offender's term of imprisonment. 
  1.19     (c) This section does not affect time spent on work release.
  1.20     (d) When a court awards credit for time served in custody, 
  1.21  the court shall compute each day of credit in the same manner 
  1.22  that it computes days of imprisonment under paragraphs (a) and 
  1.23  (b).
