A bill for an act
relating to nursing homes; permitting nursing home inspections by nursing home
personnel; amending Minnesota Statutes 2008, section 144A.10, by adding a
subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.
Minnesota Statutes 2008, section 144A.10, is amended by adding a
subdivision to read:

Effective January 1,
2010, or upon federal approval by the Centers for Medicare and Medicaid Services,
whichever is later, notwithstanding subdivisions 1 and 2, a nursing home may be inspected
by a team consisting of nursing home administrators and directors of nursing from other
nursing homes licensed in the state in lieu of an inspection by the commissioner of health
up to once every 24 months. A nursing home administrator or director of nursing who
performs inspections under this subdivision may not inspect the nursing home at which
that person is employed. Inspections performed under this subdivision must be conducted
with a consultative approach.
