  1.1                          A bill for an act 
  1.2             relating to human services; extending the deadline for 
  1.3             commencing construction for previously approved 
  1.4             moratorium projects; providing for expired and 
  1.5             canceled proposals; amending Minnesota Statutes 2002, 
  1.6             section 144A.073, by adding subdivisions. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 144A.073, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 10.  [EXTENSION OF APPROVAL OF MORATORIUM EXCEPTION.] 
  1.11  Notwithstanding subdivision 3, the commissioner of health shall 
  1.12  extend project approval for an additional 18 months for any 
  1.13  proposed exception to the nursing home licensure and 
  1.14  certification moratorium if the proposal was approved under this 
  1.15  section between July 1, 2001, and June 30, 2003. 
  1.16     Sec. 2.  Minnesota Statutes 2002, section 144A.073, is 
  1.17  amended by adding a subdivision to read: 
  1.18     Subd. 11.  [FUNDING FROM EXPIRED AND CANCELED PROPOSALS.] 
  1.19  The commissioner shall monitor the status of projects approved 
  1.20  under this section to identify, in consultation with each 
  1.21  facility with an approved project, if projects will be canceled 
  1.22  or will expire.  For projects that have been canceled or have 
  1.23  expired, if originally approved after June 30, 2001, the 
  1.24  commissioner's approval authority for the estimated annual state 
  1.25  cost to medical assistance shall carry forward and shall be 
  1.26  available for the issuance of a new moratorium round later in 
  2.1   that fiscal year or in either of the following two fiscal years.
