  1.1                             A resolution
  1.2             memorializing Congress to provide for an expiration 
  1.3             date on tribal-state gaming compacts under the federal 
  1.4             Indian Gaming Regulatory Act. 
  1.5      
  1.6      WHEREAS, Minnesota has signed 22 compacts with Indian 
  1.7   tribes in the state for class III gaming under the federal 
  1.8   Indian Gaming Regulatory Act; and 
  1.9      WHEREAS, Minnesota was among the first states in the nation 
  1.10  to negotiate such compacts; and 
  1.11     WHEREAS, negotiations for those compacts were conducted 
  1.12  within strict time constraints set out in that act; and 
  1.13     WHEREAS, tribal-state compacts negotiated in Minnesota were 
  1.14  never submitted to the legislature for review; and 
  1.15     WHEREAS, each compact negotiated in Minnesota has no 
  1.16  expiration date, making renegotiation impossible unless agreed 
  1.17  to by the signing tribe; and 
  1.18     WHEREAS, the expansion of class III gaming in Minnesota 
  1.19  under these compacts has been far more rapid than was foreseen 
  1.20  at the time the compacts were negotiated, leading to a number of 
  1.21  concerns related to economic impact and increases in problem 
  1.22  gambling; and 
  1.23     WHEREAS, this expansion has made it necessary and desirable 
  1.24  for the state to review the terms of these compacts to determine 
  1.25  if their terms are still adequate to meet all the valid public 
  2.1   policy concerns raised by casino gambling; NOW, THEREFORE, 
  2.2      BE IT RESOLVED by the Legislature of the State of Minnesota 
  2.3   that Congress should amend the Indian Gaming Regulatory Act, 
  2.4   Public Law Number 100-497, to provide an expiration date for all 
  2.5   compacts negotiated by the State of Minnesota under that act. 
  2.6      BE IT FURTHER RESOLVED that any such amendment should not 
  2.7   relieve the state of its obligation under that act to negotiate 
  2.8   in good faith with any Indian tribe requesting negotiations with 
  2.9   the state. 
  2.10     BE IT FURTHER RESOLVED that the Secretary of State of the 
  2.11  State of Minnesota is directed to prepare certified copies of 
  2.12  this memorial and transmit them to the President of the United 
  2.13  States, the President and Secretary of the United States Senate, 
  2.14  the Speaker and Clerk of the United States House of 
  2.15  Representatives, and to Minnesota's Senators and Representatives 
  2.16  in Congress.
