  1.1                          A bill for an act 
  1.2             relating to counties; authorizing Koochiching county 
  1.3             to exercise the power of eminent domain for 
  1.4             acquisition of certain trust fund land. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [AUTHORIZING EXERCISE OF EMINENT DOMAIN; 
  1.7   KOOCHICHING COUNTY.] 
  1.8      Subdivision 1.  [EMINENT DOMAIN AUTHORIZED.] The 
  1.9   Koochiching county board may exercise the right of eminent 
  1.10  domain in the manner provided by Minnesota Statutes, chapter 
  1.11  117, to acquire the following trust fund lands: 
  1.12     That part of the Northeast Quarter of the Northeast 
  1.13     Quarter, Section 36, Township 71 North, Range 23 West, 
  1.14     Koochiching county, Minnesota, lying northerly of a line 
  1.15     described as follows:  Commencing at the northeast corner 
  1.16     of said Northeast Quarter of the Northeast Quarter; thence 
  1.17     South 0 degrees 26 minutes 39 seconds East, bearing 
  1.18     assumed, along the east line of said Northeast Quarter of 
  1.19     the Northeast Quarter, a distance of 60.00 feet to the 
  1.20     point of beginning of the line to be described; thence 
  1.21     North 90 degrees 0 minutes West a distance of 173.04 feet; 
  1.22     thence North 83 degrees 31 minutes West a distance of 68.90 
  1.23     feet; thence South 88 degrees 09 minutes West a distance of 
  1.24     25.85 feet; thence South 70 degrees 06 minutes West a 
  1.25     distance of 77.87 feet; thence South 84 degrees 45 minutes 
  2.1      West a distance of 128.97 feet; thence South 63 degrees 22 
  2.2      minutes West a distance of 82.56 feet; thence South 79 
  2.3      degrees 59 minutes West a distance of 41.43 feet; thence 
  2.4      North 75 degrees 19 minutes West a distance of 77.77 feet;

  2.15     104.62 feet to the intersection with the west line of said 
  2.16     Northeast Quarter of the Northeast Quarter and said line 
  2.17     there terminating, which point of intersection is 165.84 
  2.18     feet South of the northwest corner of said Northeast 
  2.19     Quarter of the Northeast Quarter; said tract consisting of 
  2.20     4.06 acres, more or less. 
  2.21     Subd. 2.  [DISPOSITION OF LAND.] (a) After the Koochiching 
  2.22  county board acquires the land described in subdivision 1, the 
  2.23  county board shall convey to the nominal titleholders their 
  2.24  respective interest in the land described in subdivision 1, as 
  2.25  determined by the Koochiching county surveyor.  Minnesota 
  2.26  Statutes, section 373.01, clause (4), does not apply to 
  2.27  conveyances under this subdivision.  Each titleholder shall 
  2.28  reimburse the county board for a proportional share of the cost 
  2.29  of the eminent domain proceedings. 
  2.30     (b) The Koochiching county board may vacate the road 
  2.31  designated as Withrow Drive according to the plat of Withrow 
  2.32  Point and may relocate the road as county road 137, as county 
  2.33  road 137 exists on the effective date of this act.  The 
  2.34  Koochiching county surveyor shall prepare and file a corrected 
  2.35  plat of Withrow Point.
