  1.1                          A bill for an act 
  1.2             relating to civil actions; establishing a 
  1.3             state-of-the-art defense to certain product claims; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 604. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [604.021] [PRODUCT DESIGN, TESTING, AND 
  1.8   LABELING; STATE-OF-THE-ART DEFENSE.] 
  1.9      In an action brought against an assembler, designer, 
  1.10  supplier of specifications, distributor, manufacturer, or seller 
  1.11  for damages from an alleged defect in the design, testing, 
  1.12  manufacturing, formulation, packaging, warning, or labeling of a 
  1.13  product, it is a defense to a claim if the person against whom 
  1.14  the claim is made pleads and proves that the product conformed 
  1.15  to the state-of-the-art in existence at the time the product was 
  1.16  designed, tested, manufactured, formulated, packaged, provided 
  1.17  with a warning, or labeled. 
  1.18     Sec. 2.  [EFFECTIVE DATE.] 
  1.19     Section 1 is effective the day following final enactment 
  1.20  and applies to claims arising from incidents occurring on or 
  1.21  after that date.
