  1.1                          A bill for an act 
  1.2             relating to corrections; providing for collection of 
  1.3             local correction fees; amending Minnesota Statutes 
  1.4             1998, sections 244.18, subdivisions 3, 4, and 5; and 
  1.5             609.102, subdivision 2; repealing Minnesota Statutes 
  1.6             1998, section 609.102, subdivisions 2 and 3. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 244.18, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [FEE COLLECTION.] The chief executive officer of 
  1.11  a local correctional agency may collect local correctional 
  1.12  fees assessed under section 609.102.  The local correctional 
  1.13  agency may collect the fee at any time while the offender is 
  1.14  under sentence or after the sentence has been discharged.  The 
  1.15  agency may use any available civil means of debt collection in 
  1.16  collecting a local correctional fee. 
  1.17     Sec. 2.  Minnesota Statutes 1998, section 244.18, 
  1.18  subdivision 4, is amended to read: 
  1.19     Subd. 4.  [EXEMPTION FROM FEE.] The local correctional 
  1.20  agency shall waive payment of a local correctional fee if so 
  1.21  ordered by the court under section 609.102.  If the court fails 
  1.22  to waive the fee, The chief executive officer of the local 
  1.23  correctional agency may waive payment of the fee if the officer 
  1.24  determines that the offender does not have the ability to pay 
  1.25  the fee, the prospects for payment are poor, or there are 
  1.26  extenuating circumstances justifying waiver of the fee.  Instead 
  2.1   of waiving the fee, the local correctional agency may require 
  2.2   the offender to perform community work service as a means of 
  2.3   paying the fee.  
  2.4      Sec. 3.  Minnesota Statutes 1998, section 244.18, 
  2.5   subdivision 5, is amended to read: 
  2.6      Subd. 5.  [RESTITUTION PAYMENT PRIORITY.] If a defendant 
  2.7   has been ordered by a court to pay restitution and a local 
  2.8   correctional fee, the defendant shall be obligated to pay the 
  2.9   restitution ordered before paying the local correctional 
  2.10  fee.  However, if the defendant is making reasonable payments to 
  2.11  satisfy the restitution obligation, the local correctional 
  2.12  agency may also collect a local correctional fee. 
  2.13     Sec. 4.  Minnesota Statutes 1998, section 609.102, 
  2.14  subdivision 2, is amended to read: 
  2.15     Subd. 2.  [IMPOSITION OF FEE.] When a court sentences a 
  2.16  person convicted of a crime, and places the person under the 
  2.17  supervision and control of a local correctional agency, the 
  2.18  court shall impose that agency may collect a local correctional 
  2.19  fee based on the local correctional agency's fee schedule 
  2.20  adopted under section 244.18. 
  2.21     Sec. 5.  [REPEALER.] 
  2.22     Minnesota Statutes 1998, section 609.102, subdivisions 2 
  2.23  and 3, are repealed.
