  1.1                          A bill for an act 
  1.2             relating to flood relief; appropriating money for 
  1.3             flood relief for the area included in Presidential 
  1.4             Declaration DR-1419. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6   Section 1.  [FLOOD RELIEF APPROPRIATIONS.] 
  1.7      The sums shown in the column under "APPROPRIATIONS" are 
  1.8   appropriated from the general fund, or another named fund, for 
  1.9   fiscal year 2004 to the agencies or officials indicated and for 
  1.10  the purposes specified in this act.  Unless otherwise specified, 
  1.11  each appropriation is available until the project for which it 
  1.12  is made is completed or abandoned.  The term "the area included 
  1.13  in DR-1419," when used in this act, means the area designated 
  1.14  under Presidential Declaration of Major Disaster, DR-1419, 
  1.15  whether included in the original declaration or added later by 
  1.16  federal government action.

  2.1   Sec. 2.  TRADE AND ECONOMIC DEVELOPMENT
  2.2   Subdivision 1.  To the commissioner of
  2.3   trade and economic development for the   
  2.4   purposes specified in this section                  $ 4,125,000
  2.5   Subd. 2.  Minnesota Investment Fund                   3,375,000
  2.6   For transfer to the Minnesota 
  2.7   investment fund to make grants to local 
  2.8   units of government for locally 
  2.9   administered grants or loan programs, 
  2.10  including buyouts, for businesses 
  2.11  directly and adversely affected by 
  2.12  flooding in the area included in 
  2.13  DR-1419.  Criteria and requirements 
  2.14  must be locally established with the 
  2.15  approval of the commissioner.  For the 
  2.16  purposes of this appropriation, 
  2.17  Minnesota Statutes, sections 116J.8731, 
  2.18  subdivisions 3, 4, 5, and 7; 116J.993; 
  2.19  116J.994; and 116J.995, are waived.  
  2.20  Businesses that receive grants or loans 
  2.21  from this appropriation must set goals 
  2.22  for jobs retained and wages paid within 
  2.23  the area included in DR-1419. 
  2.24  This is a onetime appropriation from 
  2.25  the general fund and is available until 
  2.26  expended. 
  2.27  Subd. 3.  Petroleum Cleanup                             750,000
  2.28  Notwithstanding Minnesota Statutes, 
  2.29  section 115C.08, subdivision 4, this 
  2.30  appropriation is for grants to local 
  2.31  units of government in the area 
  2.32  included in DR-1419 to safely 
  2.33  rehabilitate buildings if a portion of 
  2.34  the rehabilitation costs is 
  2.35  attributable to petroleum contamination 
  2.36  or to buy out property substantially 
  2.37  damaged by a petroleum tank release. 
  2.38  This is a onetime appropriation from 
  2.39  the petroleum tank release cleanup fund.
  2.40  Sec. 3.  HOUSING FINANCE AGENCY
  2.41  Subdivision 1.  For transfer to the housing
  2.42  development fund for the programs specified
  2.43  in this section                                       3,000,000
  2.44  Subd. 2.  Economic Development and     
  2.45  Housing Challenge                                     3,000,000
  2.46  For the economic development and 
  2.47  housing challenge program under 
  2.48  Minnesota Statutes, section 462A.33, 
  2.49  for housing assistance in the area 
  2.50  included in DR-1419.  For assistance 
  2.51  under this subdivision, the 
  2.52  requirements of Minnesota Statutes, 
  2.53  section 462A.33, subdivisions 3 and 5, 
  2.54  and Minnesota Rules, part 4900.3632, 
  2.55  are waived. 
  2.56  This is a onetime appropriation from 
  2.57  the general fund. 
  3.1   Sec. 4.  NATURAL RESOURCES                                      
  3.2   Subdivision 1.  To the commissioner of
  3.3   natural resources for the purposes       
  3.4   specified in this section                             3,125,000
  3.5   Subd. 2.  Flood Hazard Mitigation Grants              3,125,000
  3.6   $1,625,000 is a onetime appropriation 
  3.7   from the general fund for grants to 
  3.8   local units of government in the area 
  3.9   included in DR-1419 for the state share 
  3.10  of flood hazard mitigation grants for 
  3.11  flood damage reduction studies, 
  3.12  planning, engineering, and publicly 
  3.13  owned capital improvements to prevent 
  3.14  or alleviate flood damage under 
  3.15  Minnesota Statutes, section 103F.161.  
  3.16  This appropriation is available until 
  3.17  expended. 
  3.18  $1,000,000 is to buy out property 
  3.19  substantially damaged by flooding in 
  3.20  the area included in DR-1419.  This is 
  3.21  a onetime appropriation from the 
  3.22  general fund and is available until 
  3.23  expended. 
  3.24  $500,000 is for grants to local units 
  3.25  of government in the area included in 
  3.26  DR-1419 to construct ring dikes to 
  3.27  mitigate flood damage.  This is a 
  3.28  onetime appropriation from the general 
  3.29  fund and is available until expended.
