A bill for an act
relating to higher education; creating a state adjunct
to the federal educational Upward Bound or Talent
Search Trio programs; authorizing the Higher Education
Services Office to administer the program;
appropriating money; proposing coding for new law in
Minnesota Statutes, chapter 136A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [136A.861] UPWARD BOUND OR TALENT SEARCH TRIO
PROGRAMS.

new text begin The director may make grants to eligible public and private
postsecondary institutions located in this state for talent
search and upward bound programs. Program eligibility and
activities shall be the same as those under the federal Upward
Bound or Talent Search Trio programs as specified in Code of
Federal Regulations, parts 643 and 645, respectively, and other
applicable federal laws or regulations. An "eligible"
institution is an institution that has at any time received a
grant from the federal government under any of the federal Trio
programs created by United States Code, title 20, section
1070a-11. The director shall establish a competitive grant
process for the programs and develop grant application forms.
The director must award grants based on the merits of a proposal
in providing authorized program services. Grants shall be for
two years of program activities unless a shorter term is
requested. The director shall attempt to distribute grants
geographically throughout the state. The director must grant
all available funds in each grant cycle, provided there are
sufficient meritorious applications. A grantee must submit
reports to the director at the same time and containing the same
information as is required of grantees receiving federal Upward
Bound and Talent Search Trio program grants. The director may
require additional reports or information from grantees.

Sec. 2. new text begin APPROPRIATION.

new text begin $5,000,000 in fiscal year 2006 and $5,000,000 in fiscal
year 2007 are appropriated from the general fund to the director
of the Higher Education Services Office for the purpose of
section 1. This appropriation is added to the agency's
permanent budget base.
