  1.1                          A bill for an act 
  1.2             relating to the metropolitan sports facilities 
  1.3             commission; changing its name and membership; changing 
  1.4             the disposition of Metrodome net sales proceeds; 
  1.5             amending Minnesota Statutes 2002, sections 473.551, 
  1.6             subdivision 3; 473.553, subdivisions 1, 2, 3, 4, 5, 7; 
  1.7             473.564, subdivision 3; 473.5995, subdivision 2; 
  1.8             473I.01, subdivision 3. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2002, section 473.551, 
  1.11  subdivision 3, is amended to read: 
  1.12     Subd. 3.  [COMMISSION.] "Commission" means the metropolitan 
  1.13  sports facilities Minnesota sports and entertainment commission. 
  1.14     Sec. 2.  Minnesota Statutes 2002, section 473.553, 
  1.15  subdivision 1, is amended to read: 
  1.16     Subdivision 1.  [GENERAL.] The metropolitan sports 
  1.17  facilities Minnesota sports and entertainment commission is 
  1.18  established and shall be organized, structured, and administered 
  1.19  as provided in this section. 
  1.20     Sec. 3.  Minnesota Statutes 2002, section 473.553, 
  1.21  subdivision 2, is amended to read: 
  1.22     Subd. 2.  [MEMBERSHIP.] The commission shall consist of six 
  1.23  ten members, appointed by the city council of the city in which 
  1.24  the stadium is located governor plus a chair appointed as 
  1.25  provided in subdivision 3.  The governor must appoint at least 
  1.26  one resident of each congressional district as a member.  
  1.27     Sec. 4.  Minnesota Statutes 2002, section 473.553, 
  2.1   subdivision 3, is amended to read: 
  2.2      Subd. 3.  [CHAIR.] The chair shall be appointed by the 
  2.3   governor as the ninth 11th voting member and shall meet all of 
  2.4   the qualifications of a member, except the chair need only 
  2.5   reside outside the city of Minneapolis.  The chair shall preside 
  2.6   at all meetings of the commission, if present, and shall perform 
  2.7   all other duties and functions assigned by the commission or by 
  2.8   law. The commission may appoint from among its members a 
  2.9   vice-chair to act for the chair during temporary absence or 
  2.10  disability. 
  2.11     Sec. 5.  Minnesota Statutes 2002, section 473.553, 
  2.12  subdivision 4, is amended to read: 
  2.13     Subd. 4.  [QUALIFICATIONS.] A member shall not during a 
  2.14  term of office hold the office of metropolitan council member or 
  2.15  be a member of another metropolitan agency or hold any judicial 
  2.16  office or office of state government.  None of the members 
  2.17  appointed by the city council of the city in which the stadium 
  2.18  is located shall be an elected public official of that city or 
  2.19  of another political subdivision any part of whose territory is 
  2.20  shared with that city.  Each member shall qualify by taking and 
  2.21  subscribing the oath of office prescribed by the Minnesota 
  2.22  Constitution, article V, section 6.  The oath, duly certified by 
  2.23  the official administering it, shall be filed with the chair of 
  2.24  the metropolitan council secretary of state.  
  2.25     Sec. 6.  Minnesota Statutes 2002, section 473.553, 
  2.26  subdivision 5, is amended to read: 
  2.27     Subd. 5.  [TERMS.] The terms of three five members shall 
  2.28  end the first Monday in January in the year ending in the 
  2.29  numeral "5".  The terms of the other members and the chair shall 
  2.30  end the first Monday in January in the year ending in the 
  2.31  numeral "7".  Thereafter, the term of each member and the chair 
  2.32  shall be four years.  The terms shall continue until a successor 
  2.33  is appointed and qualified.  Members may be removed only for 
  2.34  cause. 
  2.35     Sec. 7.  Minnesota Statutes 2002, section 473.553, 
  2.36  subdivision 7, is amended to read: 
  3.1      Subd. 7.  [COMPENSATION.] Each commission member shall be 
  3.2   paid $50 for each day when the member attends one or more 
  3.3   meetings or provides other services, as authorized by the 
  3.4   commission, and shall be reimbursed for all actual and necessary 
  3.5   expenses incurred in the performance of duties.  The chair of 
  3.6   the metropolitan sports facilities commission shall receive, 
  3.7   unless otherwise provided by other law, a salary in an amount 
  3.8   fixed by the members of the commission and shall be reimbursed 
  3.9   for reasonable expenses to the same extent as a member.  The 
  3.10  annual budget of each commission shall provide as a separate 
  3.11  account anticipated expenditures for per diem, travel, and 
  3.12  associated expenses for the chair and members, and compensation 
  3.13  or reimbursement shall be made to the chair and members only 
  3.14  when budgeted. 
  3.15     Sec. 8.  Minnesota Statutes 2002, section 473.564, 
  3.16  subdivision 3, is amended to read: 
  3.17     Subd. 3.  [EMPLOYEES.] Upon transfer of ownership all 
  3.18  persons then employed by the metropolitan sports area commission 
  3.19  shall be transferred to the metropolitan sports facilities 
  3.20  commission without loss of right or privilege.  Nothing in this 
  3.21  section shall be construed to give any such person the right or 
  3.22  privilege to continue in the same level or classification of 
  3.23  employment previously held.  The metropolitan sports facilities 
  3.24  commission may assign any such person to an employment level and 
  3.25  classification which it deems appropriate and desirable in 
  3.26  accordance with its personnel code. 
  3.27     Sec. 9.  Minnesota Statutes 2002, section 473.5995, 
  3.28  subdivision 2, is amended to read: 
  3.29     Subd. 2.  [TRANSFER; SALE OF THE METRODOME.] Upon sale of 
  3.30  the metrodome, the metropolitan sports facilities commission 
  3.31  must transfer the net sales proceeds to the football stadium 
  3.32  account general fund. 
  3.33     Sec. 10.  Minnesota Statutes 2002, section 473I.01, 
  3.34  subdivision 3, is amended to read: 
  3.35     Subd. 3.  [COMMISSION.] "Commission" means the metropolitan 
  3.36  sports facilities Minnesota sports and entertainment commission 
  4.1   as defined in section 473.551. 
  4.2      Sec. 11.  [REVISOR'S INSTRUCTION.] 
  4.3      The revisor of statutes must change in Minnesota Statutes, 
  4.4   where appropriate, "metropolitan sports facilities commission" 
  4.5   to "Minnesota sports and entertainment commission" to conform to 
  4.6   the changes in this act.
