  1.1                          A bill for an act
  1.2             relating to state government; requiring that certain 
  1.3             purchases be made from Minnesota corrections 
  1.4             industries; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 16B. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [16B.181] [PURCHASES FROM CORRECTIONS 
  1.8   INDUSTRIES.] 
  1.9      (a) The commissioner, in consultation with the commissioner 
  1.10  of corrections, shall prepare a list of products and services 
  1.11  that are available for purchase from department of corrections 
  1.12  industries.  After publication of the product and service list 
  1.13  by the commissioner, state agencies and institutions shall 
  1.14  purchase the listed products and services from department of 
  1.15  corrections industries if the products and services are 
  1.16  comparable in price and quality to products and services 
  1.17  available from other sources.  Department of corrections 
  1.18  industries shall provide the department of administration fair 
  1.19  market value of their products and services by utilizing market 
  1.20  analysis and soliciting price lists from competitive vendors. 
  1.21     (b) No state department, institution, or agency shall evade 
  1.22  the intent and meaning of this section by adopting slight 
  1.23  variations in specifications when the products and services of 
  1.24  department of corrections industries meet specifications that 
  1.25  are reasonably adapted to the needs of that department, 
  2.1   institution, or agency. 
  2.2      (c) All purchase requests received by the department of 
  2.3   administration that involve products and services available for 
  2.4   purchase from department of corrections industries shall be 
  2.5   forwarded to the commissioner of corrections for review to 
  2.6   determine if the department of corrections industries can 
  2.7   produce and deliver the requested product or service.  A waiver 
  2.8   may be granted by the commissioner of corrections or designee if 
  2.9   it is determined that the department of corrections industries 
  2.10  cannot provide the service or product or cannot provide it in a 
  2.11  timely manner.
