A bill for an act
relating to public safety; reauthorizing that certain short term commitments to
the commissioner of corrections be served in county jails; amending Minnesota
Statutes 2010, section 609.105, subdivision 1, by adding subdivisions.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 609.105, subdivision 1, is amended to read:


Subdivision 1.

Sec. 2.

Minnesota Statutes 2010, section 609.105, is amended by adding a subdivision
to read:

new text begin A felony sentence to imprisonment
when the warrant of commitment has a remaining term of imprisonment for more than 180
days shall commit the defendant to the custody of the commissioner of corrections.

Sec. 3.

Minnesota Statutes 2010, section 609.105, is amended by adding a subdivision
to read:

new text begin (a) For the purposes of this section the terms in this
subdivision have the meanings given them.

new text begin (b) "Remaining term of imprisonment" as applied to inmates whose crimes were
committed before August 1, 1993, is the period of time for which an inmate is committed
to the custody of the commissioner of corrections minus earned good time and jail credit,
if any.

new text begin (c) "Remaining term of imprisonment" as applied to inmates whose crimes were
committed on or after August 1, 1993, is the period of time equal to two-thirds of the
inmate's executed sentence, minus jail credit, if any.
