  1.1                          A bill for an act 
  1.2             relating to the environment; conforming state 
  1.3             regulation of chlorofluorocarbons to federal law; 
  1.4             amending Minnesota Statutes 1994, sections 116.731, 
  1.5             subdivisions 2, 4, and 4a; and 116.735. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 116.731, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [REFRIGERATION EQUIPMENT.] A person processing 
  1.10  scrap refrigerators, central air conditioning units, 
  1.11  dehumidifiers, heat pumps, under-the-counter ice makers, vending 
  1.12  machines, drinking water coolers, chillers, commercial 
  1.13  refrigeration, industrial process refrigeration, or freezers 
  1.14  must remove and recycle, destroy, or properly dispose of the 
  1.15  CFCs. 
  1.16     Sec. 2.  Minnesota Statutes 1994, section 116.731, 
  1.17  subdivision 4, is amended to read: 
  1.18     Subd. 4.  [SERVICING AND RECYCLING OF APPLIANCES.] (a) A 
  1.19  person servicing or recycling refrigerators, central air 
  1.20  conditioning units, dehumidifiers, heat pumps, under-the-counter 
  1.21  ice makers, vending machines, drinking water coolers, chillers, 
  1.22  commercial refrigeration, industrial process refrigeration, or 
  1.23  freezers must: 
  1.24     (1) recapture CFCs, provide storage for recaptured CFCs, 
  1.25  and transfer recaptured CFCs to a recycler; or 
  2.1      (2) recapture CFCs and recycle the CFCs to an allowed use. 
  2.2      (b) The recovered CFCs may be properly disposed of or 
  2.3   destroyed. 
  2.4      Sec. 3.  Minnesota Statutes 1994, section 116.731, 
  2.5   subdivision 4a, is amended to read: 
  2.6      Subd. 4a.  [VENTING.] A person may not knowingly vent or 
  2.7   otherwise release into the environment any CFC used as a 
  2.8   refrigerant in appliances. 
  2.9      Sec. 4.  Minnesota Statutes 1994, section 116.735, is 
  2.10  amended to read: 
  2.11     116.735 [APPLIANCE RECYCLERS AND SERVICERS; TRAINING AND 
  2.12  CERTIFICATION.] 
  2.13     The agency shall develop standards of competence for 
  2.14  persons who service or recycle appliances engage in activities 
  2.15  relating to products that may contain CFCs, as described in 
  2.16  section 116.731, subdivisions 1 to 4, and the commissioner may 
  2.17  conduct training programs for these persons who service or 
  2.18  recycle appliances.  A person engaged in the business of 
  2.19  recycling appliances as described in section 115A.9561, 
  2.20  subdivision 2, shall, and a person who services appliances 
  2.21  may,.  The persons shall obtain from the commissioner a 
  2.22  certificate of competence or equivalent federal certification 
  2.23  that has been approved by the commissioner. 
  2.24     The agency may adopt rules to implement this section.
