A bill for an act
relating to transportation; requiring designation of an individual to monitor
compliance with underage drinking laws during transportation provided by a
motor carrier of passengers or limousine service; proposing coding for new
law in Minnesota Statutes, chapter 169.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [169.7505] SUPERVISION OF UNDERAGE PASSENGERS IN
MOTOR CARRIERS AND LIMOUSINES.

new text begin (a) A motor carrier of passengers, as defined in section 221.012, subdivision 26, that
provides charter service and a limousine service, as defined in section 221.84, subdivision
1, shall, before providing transportation services, require the chartering party to provide to
the motor carrier or limousine service in writing the name, address, and age of a designee if:

new text begin (1) alcoholic beverages will be served or transported in the passenger compartment
of the vehicle during the chartered trip; and

new text begin (2) any passengers will be under 18 years of age and not accompanied by a parent or
legal guardian.

new text begin (b) "Designee" means a person:
new text end

new text begin (1) who is 25 years of age or older;
new text end

new text begin (2) who shall be present at all times during a motor carrier or limousine trip;
new text end

new text begin (3) who is provided by the chartering party with the names of passengers under
18 years of age; and
new text end

new text begin (4) who shall make reasonable attempts to ensure compliance by passengers who are
under 18 years of age with laws concerning underage consumption of alcoholic beverages.

new text begin (c) If, during the transportation, the driver observes possession or consumption of
an alcoholic beverage by an underage person, or the designated individual informs the
driver that an underaged person has possessed or consumed an alcoholic beverage, the
trip must be terminated and the passengers returned to the point where the transportation
service commenced.
