  1.1                          A bill for an act 
  1.2             relating to occupational regulation; exempting certain 
  1.3             organizations and volunteers working on their behalf 
  1.4             from licensure requirements for electricians and 
  1.5             plumbers; amending Minnesota Statutes 1998, sections 
  1.6             326.242, subdivision 12; and 326.37, subdivision 3. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 326.242, 
  1.9   subdivision 12, is amended to read: 
  1.10     Subd. 12.  [EXEMPTIONS FROM LICENSING.] (a) A maintenance 
  1.11  electrician who is supervised by the responsible master 
  1.12  electrician for an electrical contractor who has contracted with 
  1.13  the maintenance electrician's employer to provide services for 
  1.14  which an electrical contractor's license is required or by a 
  1.15  master electrician or an electrical engineer registered with the 
  1.16  board and who is an employee of an employer and is engaged in 
  1.17  the maintenance, and repair of electrical equipment, apparatus, 
  1.18  and facilities owned or leased by the employer, and performed 
  1.19  within the limits of property which is owned or leased and 
  1.20  operated and maintained by said employer, shall not be required 
  1.21  to hold or obtain a license under sections 326.241 to 326.248; 
  1.22  or 
  1.23     (b) Employees of a licensed alarm and communication 
  1.24  contractor are not required to hold a license under sections 
  1.25  326.241 to 326.248 while performing work authorized to be 
  1.26  conducted by an alarm and communication contractor; or 
  2.1      (c) Employees of any electric, communications, or railway 
  2.2   utility, or a telephone company as defined under section 237.01 
  2.3   or its employees, or of any independent contractor performing 
  2.4   work on behalf of any such utility or telephone company, shall 
  2.5   not be required to hold a license under sections 326.241 to 
  2.6   326.248: 
  2.7      1.  While performing work on installations, materials, or 
  2.8   equipment which are owned or leased, and operated and maintained 
  2.9   by such utility or telephone company in the exercise of its 
  2.10  utility or telephone function, and which 
  2.11     (i) are used exclusively for the generation, 
  2.12  transformation, distribution, transmission, or metering of 
  2.13  electric current, or the operation of railway signals, or the 
  2.14  transmission of intelligence and do not have as a principal 
  2.15  function the consumption or use of electric current by or for 
  2.16  the benefit of any person other than such utility or telephone 
  2.17  company, and 
  2.18     (ii) are generally accessible only to employees of such 
  2.19  utility or telephone company or persons acting under its control 
  2.20  or direction, and 
  2.21     (iii) are not on the load side of the meter; or 
  2.22     2.  While performing work on installations, materials, or 
  2.23  equipment which are a part of the street lighting operations of 
  2.24  such utility; or 
  2.25     3.  While installing or performing work on outdoor area 
  2.26  lights which are directly connected to a utility's distribution 
  2.27  system and located upon the utility's distribution poles, and 
  2.28  which are generally accessible only to employees of such utility 
  2.29  or persons acting under its control or direction; or 
  2.30     (d) An owner shall not be required to hold or obtain a 
  2.31  license under sections 326.241 to 326.248; or 
  2.32     (e) Habitat for Humanity and Builders Outreach Foundation, 
  2.33  and their individual volunteers when engaging in activities on 
  2.34  their behalf, are not required to obtain or hold a license under 
  2.35  sections 326.241 to 326.248. 
  2.36     Sec. 2.  Minnesota Statutes 1998, section 326.37, 
  3.1   subdivision 3, is amended to read: 
  3.2      Subd. 3.  [EXEMPTION.] (a) No license authorized by this 
  3.3   section shall be is required of any a contractor or employee 
  3.4   engaged in the work or business of pipe laying outside of 
  3.5   buildings if such the person is engaged in a business or trade 
  3.6   which that has traditionally performed such that work within the 
  3.7   state prior to before January 1, 1994. 
  3.8      (b) No license authorized by this section is required of 
  3.9   Habitat for Humanity or Builders Outreach Foundation or their 
  3.10  individual volunteers when engaging in activities on their 
  3.11  behalf.
