  1.1                          A bill for an act 
  1.2             relating to employment; modifying provisions relating 
  1.3             to boiler inspections; amending Minnesota Statutes 
  1.4             1994, section 183.375, subdivisions 1, 2, 3, and 4.  
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1994, section 183.375, 
  1.7   subdivision 1, is amended to read: 
  1.8      Subdivision 1.  [MANAGEMENT OF DIVISION.] Subject to the 
  1.9   provisions of this chapter, the department of labor and 
  1.10  industry, division of boiler inspection, is hereby continued 
  1.11  under the management, supervision, and control of the department 
  1.12  of labor and industry.  
  1.13     Sec. 2.  Minnesota Statutes 1994, section 183.375, 
  1.14  subdivision 2, is amended to read: 
  1.15     Subd. 2.  [CHIEF OF DIVISION.] Subject to the provisions of 
  1.16  this chapter and chapter 43A, the commissioner shall appoint a 
  1.17  full-time chief and may appoint a deputy chief of the division 
  1.18  of boiler inspection within 60 days of a vacancy for the 
  1.19  position.  The chief shall be specifically authorized and fully 
  1.20  responsible for performing all functions necessary in directing 
  1.21  and supervising the administration and inspection services of 
  1.22  the division of boiler inspection.  The appointee shall be a 
  1.23  qualified steam engineer with at least ten years of operation 
  1.24  experience as such and shall be licensed as a chief Grade A 
  1.25  engineer in this state and shall possess a current commission 
  2.1   issued by the national board of boiler and pressure vessel 
  2.2   inspectors.  Inspectors employed in the division of boiler 
  2.3   inspection or employed as an authorized inspector by a qualified 
  2.4   insurance company insuring boilers and pressure vessels in 
  2.5   Minnesota may utilize up to five years of equivalent experience 
  2.6   as inspectors, in satisfying the requirement of ten years of 
  2.7   experience as steam engineers for the chief and deputy chief 
  2.8   positions position.  
  2.9      Sec. 3.  Minnesota Statutes 1994, section 183.375, 
  2.10  subdivision 3, is amended to read: 
  2.11     Subd. 3.  [INSPECTORS.] The department may in consultation 
  2.12  with the chief boiler inspector shall employ such inspectors and 
  2.13  other persons as are necessary to efficiently perform the duties 
  2.14  and exercise the powers imposed upon the division of boiler 
  2.15  inspection.  
  2.16     Sec. 4.  Minnesota Statutes 1994, section 183.375, 
  2.17  subdivision 4, is amended to read: 
  2.18     Subd. 4.  [POWERS AND DUTIES.] Subject to the provisions of 
  2.19  this chapter and chapter 43A, the department shall prescribe the 
  2.20  duties of the division of boiler inspection.
