1.1 A bill for an act 1.2 proposing an amendment to the Minnesota Constitution, 1.3 article XIII, section 3; providing for the University 1.4 of Minnesota board of regents; amending Minnesota 1.5 Statutes 1996, section 137.023; proposing coding for 1.6 new law in Minnesota Statutes, chapter 137; repealing 1.7 Minnesota Statutes 1996, sections 137.024; and 1.8 137.0245. 1.9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.10 ARTICLE 1 1.11 Section 1. [CONSTITUTIONAL AMENDMENT PROPOSED.] 1.12 An amendment to the Minnesota Constitution is proposed to 1.13 the people. If the amendment is adopted, article XIII, section 1.14 3, will read: 1.15 Sec. 3. Notwithstanding Laws 1851, chapter 3, the members 1.16 of the board of regents of the University of Minnesota shall be 1.17 elected by the voters from the area they are to serve in a 1.18 manner provided by law. Except as provided in this section, all 1.19 the rights, immunities, franchises and endowments heretofore 1.20 granted or conferred upon the University of Minnesota are 1.21 perpetuated unto the university. 1.22 Sec. 2. [SUBMISSION TO VOTERS.] 1.23 The proposed amendment shall be submitted to the people at 1.24 the 1998 general election. The question submitted shall be: 1.25 "Shall the Minnesota Constitution be amended to require 1.26 that the election of members of the University of Minnesota 1.27 board of regents be provided for by ordinary law? 2.1 Yes ....... 2.2 No ........" 2.3 ARTICLE 2 2.4 Section 1. [137.0225] [BOARD OF REGENTS.] 2.5 Subdivision 1. [MEMBERSHIP.] The board of regents shall 2.6 consist of 12 members. Eight members shall represent the 2.7 state's eight congressional districts with one residing in each 2.8 congressional district. Four members shall represent the state 2.9 at large and shall include a university student pursuant to 2.10 section 137.023. Vacancies on the board shall be filled by the 2.11 governor, with the advice and consent of the senate, for the 2.12 remainder of the unexpired term. 2.13 Subd. 2. [TERMS OF OFFICE.] As each member now serving 2.14 reaches the end of the member's term of office, a new member 2.15 shall be elected under this section. A new member shall be 2.16 elected for six years and each successor thereafter shall be 2.17 elected for six years. 2.18 Subd. 3. [ELECTION.] The election of the board of regents 2.19 shall be governed by the Minnesota Election Law. 2.20 Sec. 2. Minnesota Statutes 1996, section 137.023, is 2.21 amended to read: 2.22 137.023 [UNIVERSITY STUDENT ON BOARD OF REGENTS.] 2.23In electing members of the board of regents pursuant to2.24article 13, section 3, of the Constitution of the state of2.25Minnesota, and Territorial Laws 1851, chapter 3, section 5,One 2.26 member of the board of regents of the university shall be a 2.27 person who at the time of election to the board is a student who 2.28 is enrolled in a degree program at the university. This person 2.29 shall represent the state at large. Upon expiration of the term 2.30 or in the event of a vacancy in the office, one position shall 2.31 be filled by a person having the same qualifications. 2.32 Sec. 3. [SECRETARY OF STATE.] 2.33 The secretary of state shall propose legislation for the 2.34 election of the board of regents of the University of Minnesota 2.35 under the Minnesota Election Law to the 1999 legislature. 2.36 Sec. 4. [REPEALER.] 3.1 Minnesota Statutes 1996, sections 137.024; and 137.0245, 3.2 are repealed. 3.3 Sec. 5. [EFFECTIVE DATE.] 3.4 This article takes effect upon approval of the 3.5 constitutional amendment proposed by article 1.
