A bill for an act
relating to human services; modifying provisions related to children aging out of
foster care; amending Minnesota Statutes 2008, section 256B.055, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 256B.055, is amended by adding a
subdivision to read:

new text begin Foster children to age 21. new text end

new text begin (a) Foster children for whom the commissioner
or county has custody and financial responsibility on their 18th birthdays must be enrolled
in medical assistance upon the completion of an application and must be certified eligible
for medical assistance by the commissioner until their 21st birthdays. Once certified
eligible, reapplication is not required.

new text begin (b) Pending federal approval of the state plan amendment to implement paragraph
(a), the foster children must be covered by state-only funded medical assistance.
