  1.1                          A bill for an act
  1.2             relating to local government; authorizing home rule 
  1.3             charter and statutory cities to make grants to 
  1.4             nonprofit community food shelves; amending Minnesota 
  1.5             Statutes 1994, section 604A.10, subdivision 1; 
  1.6             proposing coding for new law in Minnesota Statutes, 
  1.7             chapter 465. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [465.039] [GIFTS TO ORGANIZATIONS DISTRIBUTING 
  1.10  FOOD.] 
  1.11     The governing body of a home rule charter or statutory city 
  1.12  may appropriate each year out of the general fund of the city, 
  1.13  or other unrestricted money, an amount to be determined by the 
  1.14  governing body to provide grants to nonprofit organizations 
  1.15  operating community food shelves that provide food to the needy 
  1.16  without charge. 
  1.17     Sec. 2.  Minnesota Statutes 1994, section 604A.10, 
  1.18  subdivision 1, is amended to read: 
  1.19     Subdivision 1.  [DEFINITIONS.] (a) For the purposes of this 
  1.20  section, the following terms have the meanings given them. 
  1.21     (b) "Distressed food" means, in addition to the definition 
  1.22  in section 31.495, certain perishable foods, as defined in 
  1.23  section 28A.03, that may not be readily marketable due to 
  1.24  appearance, freshness, grade, surplus, or other considerations 
  1.25  and are not suspect of having been rendered unsafe or unsuitable 
  1.26  for food use and are adequately labeled.  
  2.1      (c) "Food bank" means a surplus food collection and 
  2.2   distribution system operated and established to assist in 
  2.3   bringing donated food to nonprofit charitable organizations and 
  2.4   individuals for the purpose of reducing hunger and meeting 
  2.5   nutritional needs. 
  2.6      (d) "Food facility" means: 
  2.7      (1) a restaurant, food establishment, grocery store, 
  2.8   delicatessen, convenience store, vehicle, vending machine, 
  2.9   produce stand, temporary food facility, satellite food 
  2.10  distribution facility, stationary mobile food preparation unit, 
  2.11  or mobile food preparation unit; 
  2.12     (2) a place used in conjunction with the operations 
  2.13  described in clause (1), including, but not limited to, storage 
  2.14  facilities for food-related utensils, equipment, and materials; 
  2.15  or 
  2.16     (3) a farmers' market. 
  2.17     (e) "Nonprofit charitable organization" means an 
  2.18  organization that is incorporated under the Minnesota nonprofit 
  2.19  corporation act and is operating for charitable purposes. 
  2.20     Sec. 3.  [EFFECTIVE DATE.] 
  2.21     This act is effective the day following final enactment.
