  1.1                          A bill for an act 
  1.2             relating to education; allowing substitute teachers to 
  1.3             attain continuing contract or tenure status; amending 
  1.4             Minnesota Statutes 2002, section 122A.44, subdivision 
  1.5             2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 122A.44, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [HIRING SUBSTITUTE TEACHERS.] (a) The board must 
  1.10  not hire a substitute teacher except:  
  1.11     (1) For a duration of time of less than one school year to 
  1.12  replace a regular teacher who is absent; or 
  1.13     (2) For a duration of time equal to or greater than one 
  1.14  school year to replace a regular teacher on a leave of absence.  
  1.15     (b) If a substitute teacher is hired pursuant to paragraph 
  1.16  (a), clause (2), each full school year during which the teacher 
  1.17  is employed by a district pursuant to that clause shall be 
  1.18  deemed one year of the teacher's probationary period of 
  1.19  employment pursuant to either section 122A.40, subdivision 5, or 
  1.20  122A.41, subdivision 2.  The teacher shall be eligible for 
  1.21  attain continuing contract status pursuant to section 122A.40, 
  1.22  subdivision 7, or tenure status pursuant to section 122A.41, 
  1.23  subdivision 4, after completion of the applicable probationary 
  1.24  period.
