A bill for an act
relating to insurance; requiring coverage for certain injuries and illnesses to
dependent children occurring at family child care centers; proposing coding for
new law in Minnesota Statutes, chapter 62A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

CENTERS.

new text begin (a) A health plan must provide coverage for injury or illness to a dependent child that
occurs at or on the property of a family child care center, provided the injury or illness is
not the result of the family child care provider's negligence or abuse.

new text begin (b) For purposes of this section, "family child care center" means a family day care or
a group family day care, as defined under Minnesota Rules, part 9502.0315. Family child
care center does not include (1) care provided by an individual who is related, as defined
in Minnesota Rules, part 9502.0315, to the person being cared for, or (2) care provided by
an unrelated individual to persons from a single family of persons related to each other.
