  1.1                          A bill for an act 
  1.2             relating to public safety; requiring manufacturers of 
  1.3             firearms and ammunition to provide shell casings, 
  1.4             projectiles, and other information to the commissioner 
  1.5             of public safety; appropriating money for a firearm 
  1.6             ballistics identification system; proposing coding for 
  1.7             new law in Minnesota Statutes, chapter 624. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [624.7163] [HANDGUN IDENTIFICATION 
  1.10  REQUIREMENTS.] 
  1.11     Subdivision 1.  [DEFINITIONS.] For the purposes of this 
  1.12  section, the following words have the meanings indicated. 
  1.13     (a) "Dealer" has the meaning given it in section 624.7161, 
  1.14  subdivision 1, paragraph (b). 
  1.15     (b) "Manufacturer" means any person who possesses a valid 
  1.16  federal license issued by the Secretary of the Treasury that 
  1.17  permits that person to engage in the business of manufacturing 
  1.18  firearms or ammunition for the purpose of sale or distribution. 
  1.19     (c) "Projectile" means that part of handgun ammunition that 
  1.20  is, by means of an explosion, expelled through the barrel of the 
  1.21  pistol. 
  1.22     (d) "Shell casing" means that part of handgun ammunition 
  1.23  that contains the primer and propellent powder to discharge the 
  1.24  projectile. 
  1.25     Subd. 2.  [INFORMATION PROVIDED BY MANUFACTURER.] Any 
  1.26  manufacturer that ships or transports a pistol to be sold, 
  2.1   rented, or transferred in the state shall include in the box 
  2.2   with the pistol in a separate sealed container: 
  2.3      (1) a shell casing of a projectile discharged from that 
  2.4   pistol; and 
  2.5      (2) additional information that identifies the type of 
  2.6   pistol and shell casing as required by the commissioner of 
  2.7   public safety to meet the provisions of this section. 
  2.8      Subd. 3.  [DEALER CONFIRMATION.] Upon receipt of a pistol 
  2.9   from the manufacturer, the dealer shall confirm to the bureau of 
  2.10  criminal apprehension that the manufacturer complied with the 
  2.11  provisions of subdivision 2. 
  2.12     Subd. 4.  [FORWARDING OF INFORMATION TO BUREAU OF CRIMINAL 
  2.13  APPREHENSION UPON SALE OR TRANSFER.] Upon the sale or transfer 
  2.14  of the pistol, the dealer shall forward the sealed container to 
  2.15  the bureau of criminal apprehension. 
  2.16     Subd. 5.  [DATABASE ENTRY.] Upon receipt of the shell 
  2.17  casing and required information, the bureau of criminal 
  2.18  apprehension crime laboratory shall enter the information in all 
  2.19  pertinent databases. 
  2.20     Subd. 6.  [RULES.] The commissioner of public safety shall 
  2.21  adopt rules to carry out the provisions of this section. 
  2.22     Sec. 2.  [APPROPRIATION.] 
  2.23     $....... is appropriated from the general fund to the 
  2.24  commissioner of public safety for developing and operating a 
  2.25  firearm ballistics identification system.  This appropriation is 
  2.26  available until June 30, 2003.
